I hate to say this but this is the way it worked for me.  I applied for social security disability, with all the documentation they ask for.  SS then sent me forms to fill out.  I filled them out and returned them right away.  One year later I got a response DISAPPROVED.  I appealed their decision.  6 Months later I went to court.  I went and got an attorney.  He had me go get copies of all my medical records.  A copy for him, a copy for the court, and a copy for myself.  The judge ruled in my favor, and I immediately got all the back pay for a year and a half.

I know several people who are on disability, 3 in my own family.  I know of no one that got it without a lawyer.  Call legal aid in your area and request a referral.

Social Security attorneys get a set amount.  It's like 10% or $5,500.00 which ever is less.  Don't quote me on that, but I think that was the amount I settles on.  I personally did not have to pay him, SS held back the amount he was owed, and gave it to him.  But without an attourney you don't stand a chance of winning since you don't know the rules, he does.

It took my wife a year. It took an attorney to get it then.  Good luck. I hope everything works out for you.

I don't know much about this but a friend of mine did have to go on permanent disability because of disease. It took over a year of various short term disability measures before he finally got the long term disability status. In his case, he wanted to keep working, but just couldn't. It required some persistence to get the long term benefit. This  was through his work, and there was a short term and long term disability plan in the benefits package. I don't know if this relates to your case in any way, but it might because my perception is that the powers that be have to be absolutely convinced of the long term disability status before the money can be directed to you. But as I said, I don't know much about this.

My guess is that some kind of lawyer can help you out in this.

First thing you do is go to your local Social Security office and sign up.  Since it is your wife you may have to get a Power of Attorney so you can sign her name.  They will probably deny, so you will have to appeal.  Then get a good attorney that handles Social Security cases and turn it over to him.  Most attorneys will take the case for what social security pays.  And as often as you are denied, always appeal.  If you don't you will have to start over again.  It took my wife about a year to get her's started.

redboot has a good point slim

I had my mom get my power of attorney for 1 1/2yrs once, I was hit by a bomb and due to medical complications and injuries I was either in pain, medicated, depressed or just out of it..... my credit is still good so apparently it worked out fine (no one will fight you once you HAVE IT- they'll take your/her money if you got the paperwork and a story).  Remember though that you need to be sure what you're doing AFTER you get the poa so keep your lawyers number for ahwile just in case.  (make sure you know of any debts, property, medical issues... look it all up since you will be representing her from here on out)

Took me 1 1/14 year. Had to get a lawyer too. Makes a man feel  like he has to get down and beg for what he is due. You work all your life and have to fight for what you deserve. Then people like KING OBOMA WANT TO GIVE IT AWAY TO ELLEGALS!!! Makes a man wonder if his life was wasted working or not. Excuse me but that is the way I felt for 1 and 1/4 year. Like a begger asking the government for help. But I still say GOD BLESS AMERICA!!!!!

Sadly it is one more government game! You will in all likely-hood have to get a lawyer. This lawyer gets a percentage of back pay you receive. So you will not get it until enough time has passed for the lawyer to get the max he is allowed by law. remember the laws are made by lawyers!

If she can document she is half or more native American, she can qualify for a lot of government aid.  If you get in touch with any local agency's, Social Security, Human Resources, Welfare, or whatever, they might can steer you in the right directions.

Paint her face black before she goes in and it should come thru first try with no problem. The delays are only for folks who are white.

Prayers sent friend. Get social services involved. Years ago when my leg was broken I got disability for about a year. I needed a special leg brace that the medical card refused to pay for. My county health dept got involved and the brace was approved because of the health depts reccomendation. Charlie.  :( :(

You've got to get the doctor on your side.  If the doctor will supply documentation that your wife is indeed disabled, she should eventually win, but she will more than likely be turned down on the first go-round.  She might even lose the first appeal, but if you are persistent, you will probably be approved.

I'm not so sure that I would jump right into lawyering up before you give it a couple of shots without one.  My wife got her disability after her second appeal and she didn't have to share it with a danged lawyer.  No offense to you attorney types.

A friend of mine lost his leg in an accident; he tried for years to get full disability.  He finally got it, but it took persistence and patience.  I think the SS administration hopes the applicant will die off if they stall around long enough.

One more thing that might be helpful if your wife is denied is to contact your Congressman and/or Senators.

One thing I can tell you from personal experience. If you are going to have to handle her personal affairs a power of attorney is no good with the Social Security Administration. You have to be appointed her personal represenative. What is the difference? Basically none. It's just another hoop you have to jump thru to satisfy them. I have had my mother's P-O-A for 29 years but several years ago I called to ask SS a question on her behalf and found that it wasn't good with SS. I pointed out that all legal institutions and the IRS were perfectly happy with it but they wouldn't budge. It's not a big deal but it took me an entire day at the SS office to be appointed her represenative. You will also have to fill out a questionaire every year showing how you spent her SS benefits when you become her represenative.

Good luck with the disability. I have no personal experience with it but I'm guessing it will take a lawyer. Greybeard has the right idea. Paint her face black or brown.

Slim:  I went through this with my late father, mother and wife.  Get a lawyer now!  Do not waste time trying to go down to SS to pick up forms or get information yourself as you will only be wasting your time and setting back the time your wife can be declared disabled.

Just get the damn lawyer.  These guys do it quickly as they have the experience and knowledge as to what is needed.  And make certain you don't do all the running around for he/she if they need SS forms or hosptial records or whatever.

Don't forget that when you pay a lawyer you own the sob, so make him work for you.  If he says I need 'x' from the hospital then tell him to call the hospital and request it and to give you a time when you can go and pick it up - that way you don't spend two hours waiting for some hospital slug to get you your information - and always get names and telephone numbers.

I am terribly sorry to hear about your wife but social security and the like depend on your not being able to navigate the system well enough to obtain benefits the first time you try.  I had to remind the SS people twice of information they had right in front of their faces, as they are not above telling you they don't have it and then being all surprised when they find it in their hands.

They don't screw around with lawyers as they know that lawyers can put their azzez in a bad crack if they (ss) screws up the process or wrongfully denies benefits.

One way or another you will pay a lawyer, so start that process now.  I first used a lawyer for my Dad but he died before we could finalize the process - at one point I got whizzed at this guy and asked him what the hell I was payin' him for if I was doing all the running around for him and getting info, etc.  I toldhim to work for his damn money or I would go to his senior partner to get service - he didn't like me much and when I later had to go through this with my mother I found I could do it myself (if I didn't mind standing in lines) but later felt it would have been worth the fee not to have to.........HTH.

you might contact the local ACORN office in your area.   From what I hear they are good at that kinda stuff, and probably only require a POLITACAL DONATION to their comunity ORGINAZER.  I couldnt resist that.   Jim   BTW I think their is abt. a 3 Mo. period from the date you wont get anything but like all have said it is a long time endevor but you are entitled.   Jim
