On any other day at Live Oak High School in Morgan Hill, Daniel Galli and his four friends would not even be noticed for wearing T-shirts with the American flag. But Cinco de Mayo is not any typical day especially on a campus with a large Mexican American student population.

Galli says he and his friends were sitting at a table during brunch break when the vice principal asked two of the boys to remove American flag bandannas that they wearing on their heads and for the others to turn their American flag T-shirts inside out. When they refused, the boys were ordered to go to the principal's office.

"They said we could wear it on any other day," Daniel Galli said, "but today is sensitive to Mexican-Americans because it's supposed to be their holiday so we were not allowed to wear it today."

Civil lawsuit time.  First Amendment violation of American Citizen rights under the Constitution.  VP is WRONG.  Principal is WRONG.  School Board is going to take it on the nose and the Taxpayers will foot the bill - as usual.

I do too, but in the end, regardless, the administration is wrong.  No circumstances can make the wearing of such apparel against the rules, and they're rightfully about to be slapped with the biggest 1st amendment bat in the legal arsenal.

Already the district is trying to distance themselves from this:

Free speech is restricted in public schools under a long and somewhat convoluted series of cases.  Start with Tinker v. Des Moines Independent Community School District and Hazelwood v. Kuhlmeier.  In short the administration can ask the students to remove the shirts if they will cause a disruption to education activities.

Not saying it's right, and not saying there won't be suits.  The ACLU is probably already with the families; but this is not as simple as some seem to think.

I pretty much agree.
But from my experience in the state of Oklahoma it better be spelled out in the student handbook.
Chances are that it will have to go before the school board first.
Generally speaking they use the handbook as thier guide.

But who really knows.
I suspect we'll never hear how it turns out.

And as I said my only experience is in Oklahoma.

If you look at the videos one of the boy's mothers is speaking.  She's obviously Hispanic and specifically says that her son is partially Hispanic.  This isn't a racial issue.  The United States Flag and the Cinco de Mayo holiday relate to political groups, not racial ones.  The first amendment issue is what's at hand.  Saying that it's racial discrimination against white children is directly associating the American flag WITH white children exclusively, which is simply not valid (not in general, and not even in this specific case).

I've worked with school systems before requesting use of facilities on Sundays for Church plants, or Churches without a building. My impression is that Principals and VPs typically are walking a tight rope, with no actual school board guidance as to what is right or wrong. So they make the call based on their own convictions. In my cases, one Principal would claim separation of church and state and reject the request, but then their replacement would treat it like they would any other community organization that wanted to rent the unused space and approve it - removing the "religion" question from the dialogue.

In this case, I would not be suprised to learn that the school admin really is operating without guidelines from a school board. They made a personal call, feeling empowered to do so in the absence of any other leadership, and thats a scary and dangerous place to have idealogues. If every other school in the district enforced the same thing, citing a reference from the board, then go at the board. But I'm guessing thats not the case here. We the people get what we inspect, not what we expect, and they will get away with whatever we let them.

From what I understand Cinko DeMio isn't even a national holiday in Mexico.  It was pushed by the Carona beer distributors to increase sales in the good ol USA.

I really don't care. I think it's great that the principle bowed to the minorities, and went against the boys wearing American flags on their shirts. If it happens enough, then maybe more Americans will get some back bone, and kick the illegals out of our country. Then and only then will America, once again be, America.
The will of the people is nothing more than an expression and a bad joke now. It is the will of the minority, and the will of the government. Citizens don't count.
And as far as the ACLU gettin involved. That's just what we need is that bunch of jackasses involved. Their the damn reason cincodemayo is recognized in the first place. A minority with a lawyer is a dangerous thing now a days.

I posted a couple of SCOTUS opinions on the subject above.  It would be good reading on this topic.  In short, you are correct, children in public schools do not have unfettered freedom of speech that someone might have on a street corner.

This kind of stuff has been going on for years in California public schools. Only recently has it attracted widespread attention like this California incident in Morgan Hill.  I am personally aware of incidents of gag rules being on American (white) children by school administrators because of threats from Mexicans. The Mexicans are organized in racial supremacist organizations like La Raza (The Race) and Mecha.  They are oganized on school campuses, have faculty advisors and taxpayer underwriting. 

White children are routinely oppressed and brualized by these savages. There is not a single white civil rights organization in this country to help white victims of racially motivated violence by non-white savages.   All of the "Minorities" have multi-million dollar organizations to file civil rights lawsuits on behalf of arrived "minorities."  By contrast, any attempt to help white vicitms of racially motivated violence  will be met with calls of "racism" and attacks at every level.  We are going to have to learn to play the race card and fight back if we don't want to be exterminated.  It's that simple.  This Morgan Hill CA incident is the first example of a highly publicized act of anti-white discrimination. Thank God!

Public school is one of those things were if you choose to attend you abide by their rules...simple as that, and NO children in public school do not have constitutional rights while in that school.  The case sited above is an outrage because there was no 'rule' saying they couldn't wear the American flag on a Mexican holiday.  I betcha next year it will be in the rule book or the issue will be solved with not wearing any logo's at all.  We as adults are the ones who have to make sure our rights and the rights of our children are being protected in or out of school.  It is the school board that makes the rules and those are elected members.  You don't like the rules of the school your kids attend have them changed, replace the board members, change schools, or teach them at home.   Many options to ensure the rights of your children...just takes a lot of time and effort.

Well, this just shows that when you think you smell a rat, it's probably because there is one. This story confirms that a chapter of Mecha, a Mexican supremacist organization, has official club status at Live Oak H.S. in Morgan Hill.

"It was revealed earlier this week that the school officially sponsors a Mexican nationalist group, MEChA, as one of the Live Oak’s extra-curricular clubs, alongside the chess and drama clubs. MEChA’s mission is, “as a nationalist movement we seek to free our people from the exploitation of an oppressive society that occupies our land.”

Update:  Hispanic Gang violence threatened against American kids who displayed the American flag. 

American children threatened with physical violence by "minorities"  for showing our national symbol in a public school.  These savages need to be rounded up and shipped back to where they belong....MEXICO!

Children in public schools do have constitutional rights.  Haven't you ever heard of Brown v. Board of Education?  Civil Rights Act of 1964? 

You think negroes and mexicans have no constitutional right to attend white schools?

Well  school administrators with brown skin do not have the  legal power to grant free speech rights to  students with brown skin like them, and to impose a gag rule on other students with white skin.  They violated the 1st and 14th Amendments, Brown vs. Bd of Education and the Civil Rights Act of 1964, just for openers.  If you grant legal protection to people with one skin color and deny legal protection to people with a different skin color in public schools, that is per se unconstitutional.

It's funny you should mention that.  I was just telling Matt earlier today that the funniest part of this whole not being allowed to wear American Flag shirts on Cinco De Mayo was just wrong considering that Cinco De Mayo is ultimately an AMERICAN holiday started by AMERICANS.  We got to looking at the calendar and noticed there were no Hispanic holidays we celebrated here.  The fifth of May was chosen because at the time they chose that date it was the last time that a foreign country had invaded North America.  It was labeled with the Spanish translation of the date so that we could say it was a Mexican holiday when actuality we created it and were THE ONLY ones who celebrated it for over 20 years.

America and its courts are getting to the point that if the courts will not enforce the laws and constitution of the United States, citacens need to once again form vigilence commitees and start hanging the offenders. Simple as that!
