ATV's in New York State

My brother and brother-inlaw were stopped by our friendly Conservation Officer opening day of shotgun in the southerntier. We all knew that registration and insurance is mandatory if you are off of your own property, but it was never pushed.  Seems like this year they are pushing it. or at least warning. According to the officer a current NYS registration and minimum liability insurance, and last but not least a helmet is mandatory. He gave them a pamphlet with all the rules. It didn't seem like he would press the helmet issue in a hunting situation up the hill down the hill and no joy riding. But a warning was issued. I've always complied with the registration and insurance  just as a precaution the old  Game Warden was a 1st class A$$hole, but he never bothered us about the atv's. He always did look for any little hunting infraction though. Just didn't need anymore excuse for a hassle.

Looks like permission from the landowner doesn't cut it anymore.  NYS law supercedes all. Another source of revenue.
Trying to milk the guys that use them 3 weeks a year.

I LOVE NEW YORK!!!
Register and insure your ATV but keep them off our state land.

Did I read your post correctly?  Your brother and in law were in fact in violation, and knowingly so, and the warden gave you a warning and a pamplet with info rather than a ticket $$$$?
So how is Conservation Officer wrong here?  Sounds like he was nice enough not to write em tickets.

I think that is what str8shooter48 was saying. This WCO was being fair with the implementation of a new enforcement program. Giving out only warnings.  str8shooter48 was just warning us to look out for the bad WCO who may not be so nice!

Pa-Joe, Thanks for understanding the point I was trying to make in my post. I just wanted to let people know that there may be a crackdown on the laws that were previously let slide.

Markc, I wasn't bad mouthing or getting down on the game warden for doing his job. I thought it was pretty damn decent of him not to ticket the parties involved. I figured there would come a day when they started enforcing the laws that were on the books. I never worried about the laws as my ATV was registered and insured from the onset of the laws.

The only thing that bothered me a bit was the pamphlet.#1. Why didn't I ever recieve a pamphlet with the rules from NYS when my registration came? Then I would have known about the helmet end of it. #2. Why aren't the laws posted in the NYS hunting syllabis? The only thing thats mentioned about ATV's in that publication is: It is unlawful to operate an ATV on state land. I know myself and a lot of other hunters out there use their ATV's for hunting purposes then park it for the rest of the year. I understand its a privilege to have permission to use your ATV on private property whether it be for hunting or whatever. My gripe is with NYS, publicize the rules for all to see. The hunting syllabis, is a great place to start. If you know the laws and don't comply you deserve the ticket.
