How is that fair?
« on: February 22, 2011, 12:24:39 PM »
I heard a story today that a local chap is looking at 75 years in prison for recording the police.  Now I'm not sure of all of the circumstances  and all, but even the thought of that is revolting.  Considering that I have heard of people murdering 2 or 3 people and only getting 10 or 15 years with parole.  Someone explain to me how are judicial system if fair?

The judicial system is as corrupt and illegal as the illegal unConstitutional laws it supports. This is another prime example, of where exercising the Right of Jury Nullification should be employed. The reason some locales make laws like this is to avoid law suits when the LEO's get out of hand. In other words, they make lying legal. Ahh but only for those in power. Defend Freedom, exercise Jury Nullification and TAKE this nation back from our corrupt lawmakers.

The music industry is going after "pirates". Big money gets what big money wants. Mainly they are trying to keep people from distributing copies and making money on them. The artists get nothing when thier work is stolen. I agree murders should not get off with 7 years.

The jury nullification won't work against the copyright laws. Jury nullification works when you can get 12 people to agree that the law someone is being tried under is unconstitutional.

Before I would be too alarmed at a hearsay, or preliminary news story, I would wait for the details.  You might find out that it is nothing more than a teaser to catch your interest.

Our justice system might be the worst, except for all the rest in the world.  Since the election of the obamanation and the appointment of Eric Holder, it has had a marked turn for the worse.

it only takes  ONE  ''not guilty'' to nulify  the law in that case

so why do folks try to get out of jury duty

I may have missed something here, are talking about recording police activities, or recording police the the band?

Either way. J.N. does come into play here, what amounts to a life sentance for illegaly recording music is just plain ludacrist.

Yep, only one person to hang the jury. Our jury selection process is set up to pick people who will help the prosecution "stack the odds ". I have jury duty next month, I'm going for #2. How many crimes are committed in our society that are more offending to "the people", than what gooberment has committed by going outside of our Constitution? Give it back to the system,Return Liberty, exercise your Right of Jury Nullification.

Jury nullification can be done but only if the 12 jurors agree to nullify the law.
1 not guilty vote only allows the person to walk, it does not equal jury nulification.

I have served on a few jurys, if I were going to try for jury nullification I would make sure I had studied up on it and had a good argument to convince the other 11. When you start talking jury nullification in the court room or jurors room you can expect to be asked some very serious questions.

I'm mean acual cops, not police the band,  sorry forgot that most of you are old enough to have grow up with them.  I heard this from my grandpa, from the kids brothers own mouth.  I honestly doubt that it comes to that, but even the thought of that kinda sentence for less then murder charges is insane.

What kind of recording was it? Video or a wire tap on thier phone lines. Hacking into the police station and controling cameras? Recording plans from an anti organized crime unit? Recording pictures of undercover drug enforcement?

These recordings could put officers lives in more danger then they all ready are. There is alot of this story left out. I do agree murders tend to get off easily but I would bet the guy doing the recording could plea bargain his way out.

For once Beerbelly and I agree on something (:  Alcohol is legal. If it was illegal that would be different.  The law is what it is until it is changed.  Personally, I think a lot of that is "social exceptance". Its usually a better image when two persons share a glass of wine as opposed to a water bong. As far as public servants being alcoholics...... I think that could be said for any walk of life. I worked a high tech private  company facility years ago part time when they were receiving threats from laid off employees. They had beer available at all times to employees of their company in their main breakroom.

Define "fair". Some murderers get the death penalty, some get life, some get 10 years. Different sentences for the same crime.
What does a rapest "deserve" that's "fair"...what about a child rapest ...what's "fair".....  it's the same crime.
Some one is breaking into your house, do you shoot him??  If you do,does that make you a murderer?? He didn't break in, he was just (in your opinion) trying too break in.
See, many things come into play. Where you are, your past, who you are, who you know, money, victims, circumstances.......many many different  factors. It's simple to me, don't break the law, and you won't have to do 3 days or 75 years.
You say you've heard of people murdering 2-3 people. Must have been here in Tennessee......some people just need killing. lol,
If your gonna be stupid, you had better be tough.

There is no right to fairness but all should be treated equally under the law.
If recording the police puts them in danger I suggest that guard their speech and actions in public.
There is a fellow I know that is up on charges of asault on a police officer a charge that should just be asault. It makes no difference whether you are police officer, judge, public official or the President asault is the same as it is for John Q Public. The beruocrats and  so called representitives should not have any more special protection under the law than the rest of us.
