He and people like him fought and died to give you the right to do it. Just because you can doesnt mean you should.

I think the actions of these people is a slap in the face to all vets and there faimlys.

Don't like the message they present but that makes the first amendment even more important. An 8-1 ruling is good here.

As much as I hate their actions and intentions I have to agree with them as being within the first A.

If they are misinterpreting anything, will they have to answer or even pay for it later? Could be.

A lot of people thing that the tea party is just as wrong. These things need to be defended. It's refreshing and really unexpected to see a bit of unity in the supreme court on a basic constitutional question. Do you happen to know who the 1 was?

How does the first amendment apply to a PRIVATE funeral? A funeral is not a government function. Whats next? Should someone be allowed to stand in your living room and protest you because its a protected right?

What about the rights of the family of the fallen to mourn in peace?

Scalia was the one I think.

I hate to say it but the Phelps actions are covered under the first ammendment. Since they are all up in political issues as a "church" thier tax exempt status should be revoked. In my opinion a church is for spiritual needs not political whims or abuse of other people. People like the Phelps calling themselves a church have the spirit of the anti christ. They drive more people away from God than anyone else.

The framers of the constitution had a the reasonable person test. Yes you can say anything you want, that is protected but falsley shouting fire in a crowded theater wasn't. What I mean to say is - You may not like what I am saying and if I get knocked on my butt for saying it would the reasonable person take the same action. In the Phelps case I would like to knock a few people on thier butts.

It was Alito. That means Roberts, Scalia, and Thomas agreed with the majority (Roberts wrote the opinion).

Fire in a crowded theater is bad example because there is no political value in that "speach". This type of protest, like it or not, is clearly related to a political statement, and has a higher degree of protection.

I won't lose any sleep if you hit them, but expect to be sued. That's what they hope for.

Fire in the theater may be a bad example. Yes these people are wanting to sue somebody, anybody, for that matter.

I won't lose any sleep over them either. One way or another they will be held accountable for all thier actions, just as I will be held accountable for all of mine. Hopefully they will just go away, but they are like a bad odor, it's just there and you can't get rid of it.

NOBODY should have the right to protest ANYTHING at the funeral of a fallen American warrior. I'm just real sorry they're from Kansas!If the media would quit talking them up so much,they'd not be getting any where.You can bet your butt that the Patriot Guard will keep them at bay at all soldiers funerals!!The guard did start in Mulvane,Kansas as a means to keep the westboro group at bay locally.Thanks God it's spread Nation wide.My Son rides for the Mulvane chapter.

Been thinking a bit more about this. Does that decision of free speech hold on private property? Aren't most cemetaries private property? That being the case, wouldn't cemetary owners be able to have the protesters removed?

Most the ones around here are own by the township I believe. There was a solider buried a town over, and westfail was there, as well as the Patriot Guard. It is very sad to see these people showing up and disrepecting anyone, let allow a soldier that payed the ultimate sacrifice defending THIER RIGHT to do these protest. In a way I kinda wish that a group of people would get together and would protest at a funeral of one of their and see how many of them cry foul, but then again that would mean stooping to down to their level.

I like to believe that there is a special place in Hell for those twisted folks. They are all lawyers, the ones in charge, and they know their "rights" so to speak. +1 Spirithawk. For all the bad sides of the draft, I can honestly say that I don't know too many draftees that are that torqued off about serving. Most are downright proud. bring back national service and return "direction" to our people. Alot of folks have no sense or direction about themselves IMO. maybe the korny movie "Starship Troopers" illustrates it best, ya want to vote, have kids, go to college? You have to be a citizen first. The only way to be a citizen is through national service. Not a bad idea IMO.

Morality and Legality are, thankfully, two separate things. From what I've read, they typically protest on public property and offer no violence. I'll bet LEO are just itching for them to make one tiny little mistake to lock as many up as they can, and I hope they do. Unfortunately, they seem to be very well coached on what is the "legal" line and rarely if ever cross it. I'm glad they won the case. I also hope it makes them more bold and they finally cross that "line" and get a few weeks in a rough county lockup to meet a few real queers.

My VFW is made aware of a Veteran's 'return home' so as to be able to provide a Honor Guard and I have heard some of the men and women pointedly state they would not let any protesters off the buses if they came - they said they would be able to jeer, rant and protest all they want, from the windows of the buses but not set foot on the ground. They feel the easiest strategy is to simply surround the buses to prevent them from moving forward or rearward to discharge their carrion eating protesters with a few ballbats or billy clubs to inspire them to remain seated. Personally owned vehicles would be subject to severe vandalism and the health and well-being of the protesters would be in serious jeopardy.

Thankfully, morality and legality are two separate things.

That corny movie Starship Troopers was written by Robert Hienlien. He was a naval officer, alot of his books are outstanding, and had some political points. Part of the thought to become a voting citizen was after you have served in the military. This way a citizen had something invested in society. Not a bad concept.

Spirithawk hit the nail on the head, the Phelps' should spend some time in a warzone.

Actually, if the facts were what was reported on the news, the protesters were 1000 feet from the site of the funeral. This ruling, although frustrating in many ways, should reinforce the First Amendment and that can't be bad.

I'm not a religious person, but if I were, I would have to embrace the axiom that the Lord works in strange ways.
