Legislation has been introduced into the Texas House of Representatives that directly challenges the authority of the TSA in airports within the state, specifically aimed at criminalizing the use of naked body scanners and enhanced pat-downs.
Rep. David Simpson (R-Longview) introduced a set of bills earlier this week that would empower the Texas Attorney General to bring suit in court against any airport operator who installs or uses the full body imaging equipment or any operator who touches a person without consent and searches them without probable cause.
The bills, HB 1938 and HB 1937 would see criminal and civil penalties handed out to any TSA worker who was found to have contravened the laws.
HB 1938 reads in part:
(b) An airport operator may not allow body imaging scanning equipment to be installed or operated in any airport in this state.
(c) An airport operator commits an offense if the operator fails to comply with Subsection (b).
(d) An airport operator who commits an offense under Subsection (c) is subject to a civil penalty in an amount not to exceed $1,000 for each day of the violation.
HB 1937 includes the following:
(3) as part of a search performed to grant access to a publicly accessible building or form of transportation, intentionally, knowingly, or recklessly:
(A) searches another person without probable cause to believe the person committed an offense; and
(B) touches the anus, sexual organ, or breasts of the other person, including touching through clothing, or touches the other person in a manner that would be offensive to a reasonable person.
(f) …. An offense under Subsection (a)(3) is a state jail felony.
Constitutional watchdog, The Texas Tenth Amendment Center noted that “the Texas legislature stands on solid ground. Local governments control airports and no enumerated power in the Constitution gives the federal government the authority to regulate them. Under the Tenth Amendment, airport operation falls under state jurisdiction.”
Texas, and in particular Austin, has been at the forefront of the revolt against the TSA since it began increasing its presence in airports some eighteen months ago. In December, Austin’s Airport Advisory Commission approved a resolution advising the city council to oppose airport body scanners and invasive body searches.
The TSA has signaled its intention to install the scanners at Austin, but the date has continually been put back, with the agency saying it could now be as late as 2012 before the devices are activated.

I hope more states follow.  TSA is getting way out of hand.  We the people have to demand our government follow the Constitution.  TSA has no respect for the fourth amendment.

Osama bin Laden's boys are really, really, really hoping this bill passes.  Another result will be an end to passenger planes landing in Texas and boarding passengers.   Only someone with a death wish would board a public flight which hasn't fully screened ALL the passengers.

The porno scanners do nothing for security.  There is no need for a TSA terrorist to stick his hands down your pants.  The head of John Hopkins University radiology department says the porno scanners will cause skin cancer.  TSA terrorist sticking their hands in your pants with the same gloves they used on the last dozen victims will spread sexually transmitted diseases.  Try explaining that to your wife.  Really honey I got it from TSA.  The luggage X rays, metal detectors and old pat downs without the sexual assault were sufficient.

They have caught NOBODY because a terrorist knows dang well he/she will get caught if they try to board a plane with explosives.  In other words, the system is a bytch but it's working.  Take it away and see what happens.  BOOM!

Junior, you apparently don't watch the news. In the last few days a guy got on a plane with box cutters in his take on luggage! I guess the tsa guys were to busy looking at the nude pictures to do their job!

EL,AL is the safest airline in the world and they don't have to feel you up to keep it that way.
we need their security people here training ours and I don't mean the 8th grade drop-outs like tsa currently hires.

The most effective airport security in the world, Israel, does not need invasive tactics and is even critical of TSA. Trying to cempensate someone not doing their job with xray technology is ridiculous. Training, training, training..... I screened the original applicants to the TSA after 9/11. Trust me, these are not LEO's. Training should be increased.

That’s the point.  All this success was done without porno scanners and gate rape.  No one wants to get rid of security.  We just want to go back to what was working so well without sexual assaults.

CONCORD, N.H. -- Lawmakers and residents engaged in heated debate Tuesday over a bill that would make random airport security pat-downs and body scans criminal in New Hampshire.

The bill (HB628-FN) "makes the touching or viewing with a technological device of a person’s breasts or genitals by a government security agent without probable cause a sexual assault," according to the introductory text of the bill.

"Let's put their name on the sex offender registry, and maybe that will tell them New Hampshire means business," said bill co-sponsor Rep. Andrew Manuse, R-Derry.

"That is a crime in this state, and we should charge them every single time," said bill co-sponsor Rep. George Lambert, R-Litchfield.

It wasn't a large crowd in support of the bill, but the support was passionate. Concord's Darren Tapp said security procedures cost him a trip home for the holidays in December.

"This time, the news is talking about enhanced pat-downs," he said. "I cried on the phone with my mother that I did not wish to submit to enhanced pat-downs."

Transportation Security Administration officials would not comment on the proposed legislation except to say that security checkpoints are under federal jurisdiction. Some members of the Criminal Justice Committee said that it is a federal issue.

Nov. 18 Report: Woman Says She Was Brought To Tears By Body Scan

"We have to understand that if things need to be changed, they have to be done at the federal level, not the state level," said Rep. Laura Pantelakos, D-Portsmouth.

Some backers of the bill said TSA needs to do away with random screenings altogether and instead search only those passengers who look or act suspicious. But others said that would raise the problem of profiling.

Boston-Manchester Regional Airport does not have the controversial body scanners that can see through a person's clothes.
