There Oughta Be A Law Against It
« on: March 17, 2011, 02:13:04 PM »
Very interesting article about crime and our laws against it!

There Oughta Be A Law Against It
In order for there to be a crime there must be a victim. Government cannot be a victim, especially when government profits from crime. Most of those locked up in prison are not scary thugs and pose no threat to their fellow citizens. But incarceration is job security for the ever-growing leviathan of government. There is no such thing as a “debt to society”. Society cannot be a victim. Let me ask you a question. How does.....

We’ll teach you a lesson. We are going to throw you in jail and make the person you violated pay to keep you there. Come to think of it, we will force your family onto government assistance because you will not be able to earn a living. In addition, we are going to take you from your children so that they can depend on children services to watch out for them, and classify you as a felon so that you will never be able to get a decent job if you ever do get out of jail. Now that should make your victim feel better!”

Did the coach have any suggestions as to what we are to do with people who are genuinely dangerous to fellow citizens ?  The term "debt to society" is simply another way of saying "debt to the victim", but it is our cultural & societal entity which jails them.
He claims that the purpose of the justice system is the "make the victim whole again"..   How is this done for the victim of murder, rape or child molestation ?  Apparently by his definition, since such victims cannot be made whole...we should just allow the perpetrator go without punishment!
No, some sentences are for deterrence.  Even those who get life or death sentences may perhaps serve as a deterrent to any who may be contemplating the same crime.
While I don't deny there are many who make a living off the "justice system" and as with any government job situation, it will have it's parasites, I am still trying to sort out what he is advocating.  Is it  no justice system or is it no punishment ?
I don't know anything about this author, but he sounds like a fellow who has recently had a brush with the law and didn't like the ouitcome.

I think he is a fellow that has had a brush with the Holy Spirit.
I, also, can stand in his shoes. I understand what he is saying.
What i am hearing him say is nothing he can do will pay for what he has done---but one did pay for whet he, and all, have done.
Nothing we can do brings closure to those we have crossed paths with--but one has brought closure to him that has done the offence.

I'm very familiar with his articles in News With Views, and the coach is for capital punishment. I cannot speak for him, but I'm sure he would pull the switch himself on a Child molester, or murderer. What is it about sorting out what he is advocating your having a problem with?

Dave Daubenmire, a veteran 25 year high school football coach, was spurred to action when attacked and eventually sued by the ACLU in the late 1990’s for allegedly mixing prayer with his coaching. After a two year battle for his 1st amend-ment rights and a determination to not back down, the ACLU relented and offered coach an out of court settlement. God honored his stand and the ACLU backed off. Coach’s courageous stand, an inspiration to Americans everywhere, demonstrated that the ACLU can be defeated. (About as close as a brush with the law the coach has had!)

By taking the fight to the enemy Coach Daubenmire has become a recognizable voice with the media as he is an unashamed, articulate, apologist for the Christian world view. Coach's willingness to stand with Judge Moore in Alabama, Terri Schiavo in Florida, and the 10 commandments in Washington DC, has enabled him to partner with some of the nationally known voices in America.

Guess it was my own comprehensive difficulties..sorry..  Perhaps if I had known the background, I would have been more clarified in my assessment.

Kinda sheds light on the corruption in the courts as wel. Yes, it really is about conviction rates and how much they can squeeze out of folks making them defend themselves.

If found innocent, can a defendent sue not only  the state and the prosecution, for slander, liable, and defemation, along with damages AND win unconditionally, ALL the time? I doubt it, money only seems to flow one way in the "legal system".

Ultimately, prison has one purpose, and that's to keep those who would rape, steal, loot, and otherwise take advantage of hard working, honest people, in a place where they can not rape, steal, loot, and otherwise take advantage of said honest people.

Prison should not be for those who continue to commit serious crimes.  I believe in three strikes and you're gone and in some cases, one strike and you're worm food.  I do not believe in life sentences where violence is involved in the offense.  If the crime is that serious, the perp should be terminated.  That said, I would also support a very high standard for conviction.  As much as I believe in severe punishment, I also believe judges and juries are very unreliable.

+1

Every crime should have an assigned realistic penalty with with no strings attached and no wavers or deals.
Every crime should have a definable victim. (Realizing that one can not victimize ones self, or that the state can not claim victimization for it's self )
Every sentence should include restitution to the victim.
Maximum sentence time should not exceed 10 yrs.
10 yrs plus one day should be a sentence of death.
Upon completion of sentence convicted persons should have their full rights restored.

I have 2 nephews who work as "corrections" officers in  the  infamous ATTICA state prison.. They seem to agree that there is very little 'correcting' going on..  It more resembles corruption, rather than correction.
Don't know if it is a requirement there, but it comes in handy...they are both well over 6' tall and the smaller one is 300#. ;)  :D

I agree with IG, our prisons have become nothing more than a transient hotel, and "finishing" school to improve skills for criminals.  Prisons should not have any amenities like, law libraries, cable TV, fully equipped weight rooms, etc., some of the prisoners have it better "inside" than "outside".  So what have they got to lose when the get caught committing another crime?  Prisons should be used to punish offenders, not to coddle or correct their behavior.   I personally think that Sheriff Joe Arpiao of Maricopa County, AZ, has the right idea of what a prison should be.  I also strongly agree with a Texas saying; "In Texas, we burn our trash" (referring to the death penalty).

Although it may be frowned upon by society, a short rope and a tall tree works wonders with people like mentioned in the above posts. Strecthing a mans neck rids the tax payers of extra burden and it leaves a very graphic image in the minds of potential law breakers.
