  Burglar's family awarded $300,000 in wrongful death suitComments 356    August 26, 2011 12:13 PM  LANCE BENZEL  THE GAZETTE  An El Paso County jury on Friday awarded nearly $300,000 to the daughter of a burglar who was fatally shot in 2009 while breaking into an auto lot.
Parents of the victim, Robert Johnson Fox, embraced their attorneys after a judge announced the jury’s verdict, capping a two-week-long civil trial in which business owner Jovan Milanovic and two relatives were painted as vigilantes who plotted a deadly ambush rather than let authorities deal with a string of recent burglaries.
Phillip and Sue Fox, who filed suit for wrongful death in 2010 on behalf of Fox’s 3-year-old daughter, called the jury’s award a victory in their fight to seek accountability for the death of their son, who they say never posed a threat to the heavily armed men.
“Rob was in the wrong place doing the wrong thing, but the punishment didn’t fit the crime,” Sue Fox said afterward. “I can’t excuse his actions, but he didn’t deserve to be executed.”
The exact amount of the award was $269,500, for factors such as loss of companionship and loss of future earnings. The family will also be awarded some of the costs associated with the more than yearlong legal battle.
The jury of three men and three women deliberated for 2½ days over closely contested testimony about the predawn shooting on April 19, 2009.
Fox, 20, was shot after he and a friend scaled a fence to get inside Southwest Auto Sales at 2444 Platte Place in the city’s Knob Hill neighborhood. According to the accomplice, Brian Corbin, they had smoked methamphetamine and were looking to steal anything to buy more drugs.
Corbin testified he saw two armed men charge out of a building and run in their direction, one of them shouting “we’re gonna get you” in an obscenity-laced threat. Corbin, who escaped by climbing over a car and jumping a fence, said he felt a bullet pass by him as someone fired four gunshots.
Fox was standing inside a small shed when a .45-caliber rifle bullet passed through the shed’s door and pierced his heart.
Police said in a 145-page investigative report that the intruder had knives in his pockets and one strapped to his ankle, but never posed a threat to Milanovic or the other men, his father Ljuban Milanovic and brother-in-law Srdjan Novak.
The men are refugees who came to the United States from the former Yugoslavia in 1998.
Jurors found that Fox’s death was the result of “willful and deliberate” conduct by Jovan Milanovic, who was accused of firing the rifle, and Novak, who supplied the semiautomatic Heckler & Koch that Milanovic used in the killing.
Only Ljuban Milanovic emerged without a judgment against him.
The jurors declined to comment after the trial.
"It's been a long two weeks," one said before getting on an elevator.
The three men were accused of keeping an armed vigil over the auto lot and firing on the first burglars they saw. The men were angry over a series of thefts that began when someone broke in a week earlier and stole keys to customers’ automobiles as well as keys to buildings on the property.
Car stereos were taken in the days that followed, according to testimony.
Under Colorado’s self-defense laws, the use of deadly force is justified only under the “reasonable belief” that it’s necessary to prevent serious bodily injury or death. The jury found that none of the men had a legitimate claim of self-defense.
Property rights are not a lawful defense for using deadly force in Colorado, and the state’s so-called Make My Day law, which sets lower standard for using force, applies to households, not businesses.
For the plaintiff's attorneys, Terry Rector and Jennifer Stock, Friday's verdict ended an emotionally draining fight for the girl, Sidney Richardson, who has been cared for by the elder Foxes for the past year.
Rector, of Colorado Springs, had represented Fox on traffic matters, and said his death came as a blow.
"I can see him sitting in my office today," an emotional Rector said as participants filed out of the courthouse.
"This is a victory for Sidney Richardson. It's the only measure of justice we have - we cannot bring her father back."
Said Stock: "This jury didn't let sympathy and bias influence them. That's why we got the correct verdict that follows the law."
Milanovic and his father told police a week before the shooting they would shoot any intruders who returned. Police say the men concealed the rifle in the trunk of a car so well that a police detective initially missed it during a search.
The 4th Judicial District Attorney's Office declined to file charges in the shooting, and instead sent the case to a grand jury, which decided against returning an indictment, effectively clearing the trio of criminal wrongdoing.
The civil award has no criminal implications for the Milanovics or Novak.
Defense attorneys John P. Craver and Chelsey Burns declined to comment.

I don't see what a liberal or conservative judge has to do with it. The jury found the men guilty according to the current Colorado law (Agree or disagree with the law but that is what the law was/is.) Sounds like Colorado people need to push their legislators to enact more of a castle law like Texas or don't shoot when it is just property.

I agree with guzzijohn, not saying I like it but, the local law does not allow for lethal force in the protection of property... period end of case.   Poor judgement or knowledge of the law on the defendants parts.   Like guzzi said the folks of Colorado need to band together to get the laws changed.

 I do find the part in the police report stating that two cranked up methheads with knives "posed no threat" to be laughable.

I don't know if Colorado law allows property owners to hold trespassers at gun point until the authorities are called and on scene or not but that surely would have been a better option.

What we as responsible gun owners need to take away from this case is 1) Know your local self defense laws like the back of your hand.  2) Don't pull the trigger unless you are, or have good reason to believe that you are in eminent danger.

My point is that it doesn't seem right for the CRIMINALS family to benefit from him breaking the law. Trying to steal from hard working people to support his drug habit. Had I been on the jury I'd of said, NOT GUILTY. Somewhere right and wrong need to enter the picture. Criminals should expect to pay dearly when they steal from folks who have worked for what they have. POWDERMAN.  :o :o

Umm, yes and no.  I agree that criminals should expect to pay for their crimes.  However, was it the little girls fault that her daddy was a thieving junky?   Powderman, Should you pay for a crime that your father committed?  What if your grown son or daughter committed a crime... should you be held liable as well?

Powderman  I'm not looking to pick a fight with you just trying to show that their is a bigger picture here.  Did the criminal really deserve to die for attempting to steel property?  Not really.  Not for just steeling property.  Did the defendants break the law as it is written?  Yep.  Was the award excessive?  Probably so.  I would have awarded the family enough to cover funeral expenses and set up a small college fund for the kid that she or her family could not touch until she was of college age.

Justice was served , had these guys been allowed to kill at will with out some strong punishment it would open the door for others to follow . At some point it would get out of hand. The kid was 100% wrong as was the guy who shot him. Its more about making the shooter an example than rewarding the kid.

There's a similar recent case in Okla where a pharmacist (see Ersland) is in prison because of protecting his store.
He took chase out on the street then came back in and finished a criminal off who he had wounded earlier.
This took place only shortly before the Castle Doctrine was extended to business's.
While some may argue whether what he did was right or wrong, he would have been protected had it happened after the law was enacted.

So I reckon some of you are saying that it was the landowners fault that the little girls father thought more of his drugs and stealing from others than he did his own child?? He didn't drag the punk over the fence and force him to try and steal. Even if the punk didn't pull a gun he was well armed. Sorry guys, I can't agree with the courts decision. cases like this will be a regular occurance once we get to the point th UK is at concerning gun control etc.seems i remember reading a few years ago about a career burgular in the UK who is collecting disability plus damages from the home owner because he hurt his back entering a home to steal from it.nothing surprises me anymore.

While I feel sorry for the daughter, it is obvious that her father wasn't concerned enough about her to seek help for his drug problem, get a job and support his daughter. Also note: no criminal charges were filed.
If you enter a property, with a knife, intent on burglary, you should be prepared to suffer the consequences. What was the intended use of the knife for? I would consider that an implied threat. You show up at my door with a knife in hand, you better have a package of steaks under your other arm.
Loss of future earnings.....what earnings? as a burgular?

No not at all , The shooter could not have known the bad guy was armed since the weaopn was in a pocket and he was in a shed . Did the bad guy attack the shooter ? no . Was the bad guy a threat to the shooter not from the story. Was an attempt made to run the guy off ? no . Was the police called before the shooter went on the hunt ? no. In regard to the shooting it couldn't have happened to a better target. BUT suppose it had been kids just playing around ? That is why we as socity don't allow shooting like this to go on. Its one thing to break into an occupied building and the owner defend it but a shed ? NO. If the bad guy had pulled the knife and started toward the shooter or one of his friends it would have been OK but he did not. We shoot to stop not kill .

I think the issue is that the guy set up an ambush. Is that true? If it were true, wouldn't there be criminal charges against the land owner? Need a little more clarification on this.

The only thing that should have been considered in the case was "intent."  The family of the perps should have no bearing on the case whatsoever.
 
The dead perp's intention was to illegally enter someone elses property and steal something.  He accomplished the first intent; for that the death penalty is just.  The idea that someone should be able to illegally enter and browse around your property looking for something to steal and not be subject to being blown away is ridiculous.  Try it at my house.
 
The property owner should not be impelled by law to put himself in danger as he confronts an intruder to find out what his intentions are.  The onus is entirely on the intruder and if he chooses to step across the line ....  At some point, you naturally have the right to protect your property and your own safety.  Why should the bad guy have all the options in deciding just how serious a crime he is going to commit--once he takes that first step in the commission of a crime?  As I said, the family should not have anything at all to do with this incident.

You are so correct the owner should not put himself in danger ! He should have called the police. So you feel if a kid stumbles on your property its ok to kill him ?

Try reading what I said again.  The perp didn't just stumble onto someone elses property.  And no, you don't have to leave the protection of yourself, family and property to the police.  Why should you give up your rights to a criminal?  Yeah, if a kid happens to stumble onto my property with the intent to rob me, one of us is going to have a bad day.

YOU HAVE A RIGHT TO STOP SOMEONE ATTACKING YOU not kill them , if they die its an effect not intent. How did the guy know what the kid was doing ? Is he a mind reader ? Those facts were not known until the investigation. I have no problem with confronting a bad guy , If you choose to do so then you assume the risk and it dosen't give you the right to kill someone not causing you to fear for your life.

How about the "right" to protect your property.  Of course there is no written law that says you have the right to take a life in a given situation, but the law does allow one to protect themselves and their property.  We're only quibbling about degree and details.  When the event is in progress, the property owner should be the one with all the options.  My main point is that the family of the perp should have absolutely no roll in the matter.
