I agree if he threatens your life or the life of someone you protect then stop him. I find it commical that the ones who spout Bible verse at every chance don't apply what it says to self defense , I guess it shows their real intent with all the qoutes.

Wonder if judge's/lawyers would be so quick to take case's like this on, if they would be held responsibe, if a criminal let loose on a technicality or low bail, went out and shot an innocent victim!! Make a judge serve time for a criminal let loose early. Bet the legal system would do a real makeover of judge's and lawyer's had to set in jail, or pay a healthy fee if they screwed up. Not sure why, but Shakespear's line of, Kill all the lawyers, comes to mind. gypsyman

Very true , if you know he is out to hurt you or you can't tell then you have a right to stop him . If he has not attacked you or made advancement to do so then why would you kill him ? I the old west taking a mans horse could mean death for the man and they hung the thief . In todays world taking a radio won't cause you to die so why shoot the thief ?

Under Colorado’s self-defense laws, the use of deadly force is justified only under the “reasonable belief” that it’s necessary to prevent serious bodily injury or death. The jury found that none of the men had a legitimate claim of self-defense.
Property rights are not a lawful defense for using deadly force in Colorado, and the state’s so-called Make My Day law, which sets lower standard for using force, applies to households, not businesses.

Had that judge said, "well he should'a been able to shoot 'em, so case closed" he would have been an activist judge writing law instead of interpreting it.

Looks to me like the judge did the opposite in this case.  The criminal (the one who broke state law AND is on trial in this case) was found guilty by the JURORS, not the Judge.  The Judge then applied standard wrongful death penalties in accordance with the Law which was written by the STATE LEGISLATURE, who were elected by the VOTERS of that State.  In this case you should be blaming "Libby" voters.  The Judge did his job as defined under the Constitution.

You know that if a Judge allows his personal beliefs to color his interpretations of a Jury's verdict, it is a bad thing, right? I mean we might as well do away with Juries then.

 Some who may never faced a criminal in the act think killing is the best solution to the problem. In some cases it may be . But it better be the only good option aval. at the time. Consider in most clean shootings you will have to defend yourself. If you are smart you will not talk to police with out a lawyer present and that ain't cheap. Your loss income from missing work is a cost. You may lose your job if it happens at work , a big cost. OK you win in criminal court . Then some starving lawyer decides he might win a wrongful death suit and back to civil court. By now in some states you have invested $25,000.00 to $40,000.00 in defending yourself. So you think a car radio is worth that ?
 When I was a kid we were taught to walk in the cross walk lines at corners . We were told the person crossing had the right of way. So if you walked out in front of a car you were in the right and if the car killed you you would be DEAD RIGHT ! In a shooting you might be BANKRUPT RIGHT !

So what we need is a "victims law", where the victim of any crime should be held harmless as long as he/she reacts within certain bounds.  Those boundaries should be universal and should be well publicized so crooks and perps would be forewarned.
 
I still kind of agree with Uncle Ted's philosphy: "I'm friendly with my neighbors, but you step across my fence and I'll kill you."

 I don't desire to kill or hurt anyone . Have had the chance and would have been in the right. In one case the other guy had a gun , was comming at myself and a friend . I really think the guy didn't see me and pulled the gun on my friend. I guess it would have been self defense to have shot him. Instead I called his attention to the fact he had a 45 auto pointed at him . He holstered his gun turnned and walked away. My friend and I went home un-hurt and no cash lost , I WAS A WINNER. I do agree if you do things like any prudent person would then there should be no recourse by the family or perp. If anything if the perp has anything of value it should be used to repay what he took or destoryed.
