  NEW YORK — The arresting officer came by the cell, Samantha Zucker said, to make snide remarks about finding her with a friend in Riverside Park after its 1 a.m. closing.
For instance:
“He was telling me that I needed to get a new boyfriend, that I should get a guy who takes me out to dinner,” Ms. Zucker said. “He mocked me for being from Westchester.”
Early in the morning on Oct. 22, a Saturday, Ms. Zucker, 21, and her friend Alex Fischer, also 21, were stopped by the police in Riverside Park and given tickets for trespassing. Mr. Fischer was permitted to leave after he produced his driver’s license. But Ms. Zucker, on a visit to New York City with a group of Carnegie Mellon University seniors looking for jobs in design industries, had left her wallet in a hotel two blocks away.
She was handcuffed. For the next 36 hours, she was moved from a cell in the 26th Precinct station house on West 126th Street to central booking in Lower Manhattan and then — because one of the officers was ending his shift before Ms. Zucker could be photographed for her court appearance, and you didn’t think he was going to take the subway uptown while his partner stayed with her at booking, did you? — she was brought back to Harlem.
There she waited in a cell until a pair of fresh police officers were rustled up to bring her back downtown for booking, where she spent a second night in custody.
The judge proceeded to dismiss the ticket in less than a minute.
          News about the Police Department lately could run under the headline of the daily Dismal Development, starting with a judge declaring Tuesday that an officer was guilty of planting drugs on entirely innocent people and continuing back a few days to gun-smuggling, pepper-spraying and ticket-fixing.
Here, in the pointless arrest of Ms. Zucker, is a crime that is not even on the books: the staggering waste of spirit, the squandering of public resources, the follies disguised as crime-fighting. About 40,000 people a year — the vast majority of them young black and Latino men — are fed like widgets onto a conveyor belt of arrest, booking and court, after being told to empty their pockets and thus commit the misdemeanor of “open display” of marijuana.
Such arrests are a drain on the human economy.
Ms. Zucker said that throughout her stay in police station cells, other officers were shocked that she had not been given a chance to have a friend fetch her ID. “The female officers were gossiping that the officer who arrested me had an incredibly short fuse,” she said.
 
We are instructed by the mayor that the garish crimes of police gun-running and fake arrests are the work of rogues, not the daily toil of honest police officers. A fair point — but no more than Ms. Zucker’s observations of spiritual corruption.
“While it may have been one out-of-control officer that began the process,” she said, “no other officer had the courage to stand up against what they knew was a poor decision.”
After two days of storming design firms around the city with about 80 classmates, Ms. Zucker stopped at the hotel near West 103rd Street where the group was staying so she could drop off the bag she had been schlepping. Then she got Mr. Fischer — a classmate, not a boyfriend, the leering remark of the police officer to the contrary — to walk with her a few blocks to the park, at about 3 a.m. They wanted to see the Hudson River, which runs past her hometown of Ardsley, N.Y.
“We’re there five minutes when a police car came up and told us we had to leave because the park was closed,” Mr. Fischer said. “We said, ‘O.K., we didn’t know,’ and turned around to leave. Almost immediately, a second police car pulls up.”
Its driver said they would get tickets for trespassing and demanded their IDs. Ms. Zucker suggested that someone could bring her papers from the hotel. “He said it was too late for that, I should have thought of it earlier,” she said.
Asked about the policy, the Police Department’s chief spokesman, Paul J. Browne, said officers can allow a friend or relative to retrieve ID. He did not say if a supervisor approved the arrest of Ms. Zucker, which was attributed in court papers to a Police Officer Durrell of the 26th Precinct.
Twice, she said, the officer told her not to call him by a specific foul term.
“I said, ‘Sir, I never used that word.’ ”
        No doubt he was hearing things: the unspoken truth about his unspeakable actions.

Unusual for a second car to make an arrest after the first one has made contact and dealt with an issue. I really believe this is just police thugery. Unfortunately the brother officers did nothing.
 
One bad cop and others not not speaking up or decrying what the bad one does. That's NewYorks finest.

Sounds like someone did not get the respect they want/deserve. Now to decide who that was. Girl with attitude, now with nice news story or cop who may have simply been tired of her mouth and decided a life lesson would do her some good. Hanging out at the park trying to score some dope is not a good plan. Neither is hanging out at the park at 0100. Either situation is a fairly good way to get yourself dead, and your boyfriend too.


Now had this been November, and an election year, she would simply be a disinfranchised voter.

They were both wrong. What kind of a moron would go walking in a NY park at 3 am with no ID?? Might take a while to identify the body. The cop was wrong too. POWDERMAN.  :o :o

I'm not going to defend the cop, since I don't know what happened.   I do know this:
1. NYC parks usually close at dusk, if that particular park is opened later that dusk, closing times are posted at the entrances to the park. 
2.Riverside park runs along Morningside Heights, not the lowest crime area in NYC. 
3.You can easily purchase drugs in the park. 
4.This park recently was the location of a few rapes, including the one involving a Russian tourist by Hugues Akassy an Ivory Coast native.
5.Regardless of what the cop said about it being too late.  Miss Zucker could have sent someone back to the hotel to pick up her I.D. and have it brought to the 26th Precinct.  The I.D. would have allowed the police to release her with a desk appearance ticket.  So why, didn't her male friend do so?

So possibly this is what really happened; "dumb cop makes dumb decision, dumber perp, makes even dumber decision".

NYCity is the city that never sleeps, remember..?...these days kids are up at all hours...but arresting somebody on a bogus charge is just bogus any time of the day...this is slippery slope to national ID....

While NYC is the city that never sleeps.  City parks are closed at dusk, regardless of whether you are sleeping or not. 
 The charge is not bogus, it was for trespassing. 
 Your wrong, regarding the national I.D. allegation.  All she had to do was to produce "valid" I.D..  I use to accept any I.D. issued by a legitimate source.  However, "Times Square" I.D. is not acceptable, and no I.D. is not acceptable.  There are other ways to I.D. a person who doesn't have I.D. with them, one of my favorites was a call to the persons parents asking them to confirm the I.D. of their child, description, D.O.B., current address etc..  Apparently Miss Zucker or the officer decided not to pursue this course to I.D. her for whatever reason.

So far, what has been discussed is based entirely upon "life according to Samantha Zucker". 
Persons charged with criminal activity always tell the truth and would never think about adulterating stories to make them look innocent--------------NOT.

NYPD is normally a badge-heavy organization.   I don't believe either party, but I can tell you this.....based on the story as reported, she was not arraigned within 24 hours, as I believe is NY state law, IIRC.   If my memory is correct, then she can get this charge thrown out due to 5th and 14th Amendment due process violations.

If, her story of sending somebody to get her ID is true, and the police officer didn't let them, it's his fault. Although being in a park in NY City that late at night, is asking for trouble. Kinda like the college idiots tyhat were jailed in Iran. Book smart, street stupid. One thing this and every other cop better realize is, in the not to distant future, their going to need help, from anyone that they can get it from. And, the more regular joe citizen they pi**off, the less help they'll get in the future. gypsyman

What don't you buy?  ??? Everything I posted is a fact.  I even agree with you on the cop.  :-\

Ditto what evidrine said...Ms Zucker was held for 36 hours...why didn't the cops just tell her to get somebody to bring in her ID or call her parents, but they didn't because they were messing with her.  Furthermore, I didn't know anybody had to have an ID on them, or produce it and show an ID to anybody or any cop in the USA, outside of a current driver's license if you are operating a vehicle.  The article seems to say that it was a bogus charge for a non-existant offense....that's what I'm trying to find out.
 
Tresspassing on public property might be another bogus charge as well...but not sure; probably there's a charge for every single second of the day... ;D   Most white kids in a park at night told to move on usually move on pretty quickly.

So your finally admitting that you don't know something?  If you get arrested, you have to have a valid ID.  Try it sometime where you live, if you can't be I.D.ed you can't be released with a summons. 

The article was from the NY Times, that great unbiased news paper, wasn't it? ::)   Purveyor of the whole truth and nothing but the truth, right? ::) They get lots of facts wrong, sometimes even fabricate stories.  Remember their Pulitzer Prize winner Jayson Blair?  Just the facts, and nothing but the facts!  ;D ;D ;D   The paper no longer commands the respect that it use to, as a matter of fact it's in financial difficulty.

Trespassing is a valid charge, even if your not sure.   ;D If you want, I'll even give you the section of the law.

This took place in NYS, not the Peoples Republic of Kalifornia. ;)

Having ID on you in public is the law in many countries for many years not just as the "nice" picture above tries to imply. :(
 
 
BTW Do you remember as a Male over the age of 18 you had to have a draft card is the USA.

You did note that I said only if your arrested, right?  If Miss Zucker, had a valid I.D. on her, she would have received a criminal court summons, which couldn't be issued, because she didn't have valid I.D. on her.  Again, I stree, that nothing prevented her from giving the officer involved enough information to be identified, or as I stated, to have her male friend, bring her I.D. to the precinct.  Now ask yourself, why she didn't do that, or why he didn't do that?  I don't know the answer.

I guess what you are saying is that the cop should have written a summons to an unknown/unidentified person?  What would have prevented her from saying her name was "you" (real name of Doublebass), and gave your real D.O.B., and address.  So your saying that the cop should have written the summons to "Doublebass", because Miss Zucker claimed that was her name?  Guess who would have a warrant out for his arrest, definitely not Miss Zucker.

All the above is pretty standard for the NYPD, who prefer to be known as Our 9/11 Heroes.
Jesus said we should treat other as we'd want to be treated... and he didn't qualify that by their party affiliation, race, or even if they're of diff religion.

In the USA I don't think legally you need an ID on you in any state, as far as I know.....and you do not need to produce an ID...OSR will check and perhaps there is a law that says you must carry an ID and produce it when LEO demands inspection of said ID. Having said that most LEO go bananas when you don't ID yourself---buyer beware.!  Also, wondering if they were technically 'tresspassing', especially if any signange is not visible in the night.
 
I can not for the life of me figure out why a young women would not produce, or have somebody fetch an ID, or have her parents called thereby electing to stay 36 hours in a Harlem lockup. Remember her companion apparently showed ID and was released.  Cops were messing with her...she should see a lawyer,,,,heck, maybe her Uncle is a lawyer.. ;) ;D

TM - Please don't misquote me.  I didn't say that, I did offer to look up the section of the law, for trespassing, what you term to be: "a bogus charge for a non-existant offense".

BTW, just curious, what are you selling that you would have to say: "buyer beware,!"?  I think I know,  :-X .

Finally, we can agree on something.  I also don't understand why Miss Zucker "would not produce, or have somebody fetch an ID, or have her parents called ".  I'm sure that's what you would have done right?  She was entitled to a phone call.

You conveniently left something out when you stated: "her companion apparently showed ID and was released" after being issued a summons.

What's your thoughts on why the judge immediately dismissed this case...? Why?

From the NYS Penal Law: Title I - Offenses Involving Damage To And Intrusion Upon Property, Article 140.00 - Burglary And Related Offenses, Section 140: Criminal trespass and burglary;

There are also sections of the NYC Parks Rules & Regulations regarding Trespass, which in NYC is enforceable as a violation of the law (meaning violator is liable to arrest).

Even though, I didn't offer, I am providing the following information.  NYS Criminal Procedure Law allows a summons to be issued in lieu of arrest (allows, not required), if the violator can be properly I.D.'d.  It doesn't say you have to carry I.D, but it does say that without proper I.D. you can be arrested/detained until your properly I.D.'d. (Think Catch 22.)

Regarding the why? about the judges decision.  You'll have to ask the judge.  I remind you judges are human beings, some are easy, some are hard.  IMMO, Miss Zucker got lucky.

My quandary, I personally, don't think I have enough Handi's but, I know I have more Handi's than I really need or should have.

A case  of "cherry picking" to boost one's arrest record?

The LEO's mind was already made up. IMO
 
In this case I'll say dumb cops. Nobody should back the play of an incompetant ass. Police work should be internal as well as external.

Not distruction of property, not burglary, just a simple after hours "tresspass" in a public park? Apparently neither one of them had anything illegal on them. Lets not forget that before they arrested her she suggested that someone go and retrieve her ID and the officer stated that "It is too late, you should have thought of that earlier!" C'mon man! Why would one officer explain that they were not supposed to be there and they simply say "ok" and begin to leave when another pulls up and arrests her? You cant even claim "Failure to comply". Its all bogus BS. Thats why the Judge immediately dismissed it.  If there was anything there to charge her with it would have been brought up by the judge.

Lets also not forget that a "phone call" is a privledge, not a right. They dont have to give you one. Most of the time its not even offered until after booking is completed. She was obviously herd for quite a while before they booked her.

Nobody said anything about; "distruction of property, not burglary", in case you aren't aware, that's the way it's listed in the law.

You have the right to the phone call, it's not a privilege. You are correct regarding, the fact that the "when" of your phone call usually depends on your cooperation with the arresting officer.  That my friend is a fact of life.  You wants to play the game, you gets to pay.

Very true, you dont need to break two laws  ::) . But if that was the whole issue then the guy would not have been let go either. So apparently it had nothing to do with tresspassing. If it was all an ID thing then there should have been no reason for "its too late now..."
 
If I remember correcly the only "right" you have to a phone call is to an attorney. Other than that, its up to them.
