Going to buy a home? Where there is a HOA as a governing body? Don't whine when YOU can't break the rules YOU agreed to live by. Even if a hero of whatever description gets his/hers, they signed up for it.

While I certainly disagree with the HOA rule to not fly an American flag, it is their rule.

Their "Rule" is Illegal and not enforceable  , under the H.R. 42: Freedom to Display the American Flag Act of 2005"
To ensure that the right of an individual to display the flag of the United States on residential property not be abridged.  The Bill became law under George Bush. http://www.govtrack.us/congress/bill.xpd?bill=h109-42

The law which states in part  - a residential real estate management Association may not adopt or enforce any policy or enter into any agreement that would restrict or prevent a member of the association from displaying the American Flag.

"I pledge allegiance to the flag of the United States of America,
and to the republic for which it stands, one nation under God,
indivisible, with liberty and justice for all."

Note:  If they chose to persue the matter further , inform the HOA , an Illegal contract (either partially or fully)cannot be enforced. So now the whole HOA contract will need to be drafted for all to re-sign and you will not be signing a new one. then paint your mailbox bright Pink if they continue to harass you.

The law does not apply to renters (and the article does not mention if the officer is a renter or owner).  And the flag in question is not an American flag, but rather a "commemorative 9/11 flag".

Retired New York Firefighter Prevails
A retired New York City cop and firefighter who helped pull people from the wreckage after the World Trade Center collapsed on 9/11 will now be allowed to fly a commemorative flag in front of his home, ending a one-week battle with his homeowner's association.
 "I am really shocked," said Richard Wentz, who seemed nearly speechless after hearing the news this afternoon from ABCNews.com.
 He was initially warned by his Florida homeowner's association to remove flag or be fined.  Wentz's Coral Springs, Fla., neighborhood allows homes to display one flag, but Wentz has two: an American flag and a flag with the names of the nearly 3,000 people who died during the worst terrorist attack in American history.
 "It's not even about me. It's about the people who died that day and their families," said Wentz, 47. "They need to be remembered, not just one day of the year."
 Wentz was prepared to pay a fine that could have been as much as $1,000. But today ABCNews.com received a call from Bill Sugarman, president of Benchmark Property Management,  the company that manages Wentz's subdivision. He said Benchmark asked the homeowner's association to review their policies
 "They have concluded it's not their obligation to enforce the 'one flag' rule. Therefore, Mr. Wentz will be permitted to fly his flag," Sugarman said.  "It's really not their duty to encourage that restriction."

 -  and of course the bad press, community pressure and national attention couldn't have anything to do with their decision -  yeah right
