Is it illegal to lie to the police?
Eric E. Johnson, Law professor, attorney, blogger
Yes. Definitely. State laws vary, but the federal statute, 18 U.S.C. §1001, is very strict. That statute makes it a felony to give false statements, for instance, to FBI officers when they are investigating something. The law applies even when you are not under oath, and even if you did nothing else wrong.
Federal prosecutors use 18 U.S.C. §1001 all the time. It's a helpful way to prosecute people when more straight-forward charges won't stick. A famous example is the Martha Stewart case.
One disconcerting thing about 18 U.S.C. §1001 is that it's not a two-way street. Police officers are generally allowed to lie to you in the course of an investigation. (E.g., "Your accomplice has already confessed, so you might as well, too.")
"Obstruction of justice" is a somewhat broader term that includes things like making This isn't legal advice, I'm not advertising attorney services... (more)
threats in order to impede investigations or prosecutions. This isn't legal advice, I'm not advertising attorney services... (more)
