If you hide a phone and are asked if you have one. you say no. that is a lie to the cops which is illeagal. They can lie to you but you cannot lie to them.


Uh....this only applies to federal officers or congressional investigators, insofar as I know. You should check your local/state laws though.

If there was then almost everone would be arrested.

Yes sir I am on the way to get it fixed right now. You have better of called in advance on this one. With out the advance call you get the ticket but he can't arrest you for the lie!
The light was yellow when I went through it. You saw it turn red but he can't prove it, you get the ticket but again, he cam't arrest you for the lie.
You may be detained because of a lie but you can't be arrested for the lie itself.

We had a thread not long ago about being tracked by your own phone. That was done here recently. A punk who fired a shotgun at police was tracked to a gas station in Indiana. The news said that he was tracked from 3 different cell towers. POWDERMAN.  :o :o

There is an overt action there, clearly a felony.
The original post has the police confiscating and copying your property for minor or no offense.
In Ca we have Fix a Ticket.  Like broken windshields, where you get it fixed, signed by a police officer and send it in with an administration fee.

Longtom, in most states you cant provide false information to a cop. Did the guy walking his dogs in san fran give false statement as in his name? Seems there was a charge for that.

So get an old cell phone and charge it and keep it in your car. If ask to see your phone hand it over. Most places will allow 911 calls on any phone even ones with no plan. In the contacts put only police , fire ,EMT and 911 for the areas you travel most. When ask whats up with the phone you won't be lieing if you say its for emergency use.  ;) ;) ;) ;) ;D

Jesus said we should treat other as we'd want to be treated... and he didn't qualify that by their party affiliation, race, or even if they're of diff religion.

My comment about McCarthy is valid.  The Policy seems to be ; Who are you and who do you associate with?
My Liberal comment was about the media attacking anyone who disagrees with them or their policies.
And yes the same policy that works for the extreme right (McCarthy, Sha of Iran, Pinotche, Poppa Doc... ) works for the left (Stalin, Mao, Pol Pot, Ho Chi Mihn, Castro, Obama....)  The only difference between the two is the Media gets in volved when the right rounds up a few communists and anarchists and imprisons them, but does not get upset at the 100  to 200 Million that the communists have Murdered for free speach, for free association, for freedom.  Look at the T shirts and hats that show Che Guavara.  Doctor Ernesto Guarva, Che was a murdering communist and I find it odd that had Che had his way, you would be posed to catch rifle fire for wearing a T shirt with Washington, Jefferson, Bolivar, or MLK.

GB:  Again we have something in common, besides both being called Graybeard.  Half the time my phone is lying here next to the computer, turned off.  I know the wife's number, and my son's, so no reason to load them into the phone.  When I leave the house it's off unless I need to make a call.  If it's on it might ring and I would be tempted to answer it.  I don't believe in talking on the phone and driving.  I'm too busy dodging Cheechakoos, (Young Army Troops and their wives, that are new to driving on snow and ice.)

  A point I'd like to shine some light on.  A number of us, including me and Graybeard and Sourdough, don't have doodly squat on out phones.  Let's just call me a 'non smart phone guy' and leave it at that.  The lack of stuff on my phone doesn't make me any more willing to have it gone through by the police.  Not speaking for anybody but myself here and feel free to air your own opinions and disagree with me if you want (we are here for conversation after all).  My thinking is that if I'm not being arrested or charged with a crime, why should I allow my self to be treated like a criminal?  What right does anybody have to pick up my phone (or my notebook, paper in my case) or my computer and just look around?  No right.  The lack of exciting, indigtable content is no reason why I should allow somebody to have his way with my stuff.  Like I said at first, having nothing to hide doesn't mean I should welcome scrutiny.  Prove I'm doing something to warrant a search or leave me be.

On a similar abuse , there is a county in the area that will pull someone and check the lic on the vehicle. If the driver is not the owner and the owner has a permit to carry a weapon they ask to search the vehicle and threaten to get a warrant if not allowed. Mostly its wives and children that get abused. I had someone call me and ask what to do , I told them to tell the officer to get the warrant and list probable cause on it. They did the next time and the  officer told them they could go and have a nice day.
When your rights are threatened you are in a contest to see who has the most time. Do you have time to wait or are you willing to give up a right so you can go on with your day. Is the officer/police got time to get a warrant and all that goes with it ?
When I was in High School Custon Vans were the rage , I had a work van and got pulled . To trap heat in the driver area I had a curtian up. The officer wanted to look in the van . I refused . He got a wrrant . His sargent brought it out . His sargent was head of my sunday school dept at church. The van had a jack and spare , but nothing much else. The officer had to write me an excuse for being late to school and was getting reamed as I pulled off.
Give a few hours for freedom , many died so you would have it .

Yeah, we might find out that cell phones aren't necessarily the convenience we all thought they were.

Ever wonder if your cell could be used to listen in on your conversations with out your knowing ? Think ON-STAR .
Some say the new TV's are set up for 2 way communication , you can buy movies with the remote how hard to send back pictures and voice ?
 
I know that would be illegal right . Still better to live a clean lawful life , just in case  ;)
 
I removed the TV from the bed room !  ;D  And leave cell in the kitchen !  :o

The method I use if the officer is asking for things he has no right to and I use this ONLY when I KNOW I AM IN THE RIGHT.
I will put both arms out and tell him to arrest me and take me downtown.
I tell him either he is right and I will spend the time in jail or I am right and he will leave me alone.
Then I tell him, either way we will get to the bottom of this.
I have never been taken down yet, and if it does ever happen then I will play it out til the end.
I never show them any ID of any kind until I find out why I was pulled over.
If I don't think their question is any of their business I just don't answere.
They can't make you answere something if you don't want to.
If I have my gun with me on the seat I tell them as soon as they walk up that there is a loaded handgun on the seat beside me.
I have never been asked to let them have it or to unload it.
Just keep your hands where they can see them.
I am in VA and we are an open carry state.
I very seldom get smart with them but have been short with them a few times.
It's all in how they act when they first approach me.
Be courteous to me and you will receive the same in return.
Get smart with me and you will only get what I want to give you and nothing more.
They are no better than you or me.
 
PS, I like the idea of having an extra cell with nothing stored in it.

 It is a crime to lie to federal law enforcement. I have been warned by an MMS inspector about it. I was not lying and wasn't going to.
It is best with local law to say as little as possible and be polite, I have been threatened with a beating a couple of times over minor traffic offences, because I questioned their authority to do as they please without regard to the law. I do my best when travelling to obey the traffic laws because a stop and hassle costs more time than time saved speeding. I would have to pull out my copy of the constitution if they want to download my phone and laptop. I hope I never have to do it.

  I've only been in one road block stop.  They were looking for expired inspections.  I was driving a pickup truck with an expired inspection sticker.  OK, my bad.
 
  When I pulled in the DOT official (not a cop, there were police present) came to the window and with a clearly  exagerated, make a show for all watching attitude said "Looks like your inspection is expired, Buddy"  I replied in as flat a tone as I could "Sorry, my name isn't Buddy.  My name is Mr Williams.  You must have mistaken me for someone else."   He looked like he'd been slapped with a wet fish.  Just stood there blank and wordless.  Then he got to work and wrote me up a 'five day fix-it ticket.' 
 
  I really think that the road block fishing expeditions are un constitutional.  The Supreme court ruled that while they are unconstitutional, the public good out weighs the minor issue of peoples rights.  The roadblock is here to stay.  I'll stop because I have no choise.  If they are looking for drunk drivers I'll insist on a chemical test (I haven't had a drink of alcohol in over a dozen years, so I'm not worried at all).  I will not, under any circumstances submit to a roadside sobriety check where I am expected to stand on one foot while singing The Star Spangled banner or recite all the prime numbers or anything of the like.  I do not dance like a trained monkey for anybody, badge or no.
