(Damian Dovarganes/AP)     The White House will halt the deportation of as many as 800,000 young illegal immigrants and in some cases give them work permits, in a sweeping new initiative announced by the Department of Homeland Security.
People under 30 who entered the country illegally or overstayed their visas when they were under the age of 16 will be immune from deportation if they have not committed a significant misdemeanor or felony and have graduated from a U.S. high school or joined the military. They can apply for a renewable two-year work permit that won't provide a path to citizenship but will allow them to work legally in the country.
Homeland Security Secretary Janet Napolitano told reporters on Friday that she believed the move "is the right thing to do," and will help the agency focus on deporting criminals. "It is not immunity, it is not amnesty," she said. "It is an exercise of discretion so that these young people are not in the removal system."
Young people will have to proactively apply and pay for the temporary legal status at a local United State Citizenship and Immigration Services office. If the deferred status is granted, they can apply for a work permit.
"I wouldn't say we are encouraging people to step forward," an Obama administration official told reporters. "We are making a process available and people can make their own decision."
President Obama will address the change in a speech at 1:15 pm.
Young people who were brought into the country illegally or overstayed their visas as children are commonly referred to as "Dreamers," referencing the title of a decade-old bill that would have given them legal status if they joined the military or attended college. The Dream Act passed the House nearly two years ago, but was blocked by Republicans in the Senate. Opponents of the bill have argued that it would encourage more people to enter the country illegally, while supporters say it helps people who were brought up as Americans and whose lack of status is not their own fault become full members of society.
President Obama has faced criticism from the crucial Hispanic electorate for ramping up deportations under his tenure and for failing to deliver on his campaign promise to pass comprehensive immigration reform within his first year in office. Several times in the past year, Obama has told Hispanic audiences who asked him why he did not issue an executive order halting deportations of some classes of immigrants that such a move would be legally impossible. "There are enough laws on the books by Congress that are very clear in terms of how we have to enforce our immigration system that for me to simply, through executive order, ignore those congressional mandates would not conform with my appropriate role as President," Obama told one Dreamer who asked him why he couldn't halt young people's deportations in July. It's unclear what made him change his mind.
"We've been hearing all sorts of things from the White House, that it's not legally possible, that it's not politically possible," said Erika Andiola, a 25-year-old Arizona-based Dreamer and advocate who has met with administration officials on the subject. "I can't even believe it. We've been working for this for so long."
The move may generate enthusiasm among many Latinos: 85 percent of registered Latino voters said in a Latino Decisions poll that they support the Dream Act. The president enjoys a strong lead among Hispanic voters over Mitt Romney, but a lack of enthusiasm among these voters could mean they stay home on Election Day in swing states like Nevada, Colorado and Florida. During the primary, Mitt Romney said he would veto the Dream Act, but in recent weeks he has seen open to a proposal by Sen. Marco Rubio to grant Dreamers a worker permit but not a path to citizenship.
Republicans have rushed to criticize the move as an executive overreach. "This decision avoids dealing with Congress and the American people instead of fixing a broken immigration system once and for all," wrote Sen. Lindsay Graham, one of the few Congressional Republicans who supports immigration reform.

Today the Secretary of Homeland Security issued the attached memorandum concerning the exercise of prosecutorial discretion for certain removable individuals who entered the United States as a child.  Effective immediately, ICE agents and officers are instructed to exercise prosecutorial discretion in a manner that aligns with the Secretary’s memorandum.  The memorandum states that, with respect to individuals who meet the criteria outlined below, ICE agents and officers should immediately exercise their discretion, on an individual basis, in order to prevent these low priority individuals from being placed into removal proceedings or removed from the United States. 
An individual is covered by the Secretary’s memorandum if the individual—

•                     came to the United States under the age of sixteen;
•                     is not above the age of thirty;
•                     has continuously resided in the United States for at least five years preceding the date of this memorandum and is present in the United States on the date of this memorandum;
•                     is currently in school, has graduated from high school, has obtained a general education development certificate, or is an honorably discharged veteran of the Coast Guard or Armed Forces of the United States;
•                     has not been convicted of a felony offense, a significant misdemeanor offense, or multiple misdemeanor offenses; and
•                     does otherwise pose a threat to national security or public safety.
ICE has also been directed to apply the Secretary’s policy, on a case by case basis, to individuals whose cases are pending before the Executive Office for Immigration Review and can demonstrate that they meet the above noted criteria.  To better facilitate this process, ICE has been further directed to implement a process within sixty days that allows individuals whose cases are pending before the Executive Office for Immigration Review to request a review of their cases through the ICE Public Advocate.
Additional guidance on the Secretary’s memorandum will be issued as soon as possible.  In the meantime, if ICE personnel have questions about the exercise of prosecutorial discretion described in the Secretary’s memorandum, they should contact their supervisor or local chief counsel’s office.

GOP: New Obama deportation policy violates oath of office    Republicans are criticizing the Obama administration’s new leniency for some illegal immigrants as a politically motivated and possibly illegal effort to win over Hispanic voters.

The Republicans contend the new rules — which will prevent deportations for as many as 800,000 illegal immigrants brought to the United States as children — circumvent the law just to buy Obama support from Hispanics ahead of November's elections, in which the Hispanic vote will likely be crucial.

Rep. Lamar Smith (R-Texas), chairman of the House Judiciary Committee, said the change marks "a breach of faith with the American people."

“This huge policy shift has horrible consequences for unemployed Americans looking for jobs and violates President Obama’s oath to uphold the laws of this land," Smith said in a statement.

“How can the administration justify allowing illegal immigrants to work in the U.S. when millions of Americans are unemployed?” he added. “President Obama and his administration once again have put partisan politics and illegal immigrants ahead of the rule of law and the American people.”

On Twitter, Sen. Lindsey Graham (R-S.C.) said the policy would entice people to break the law.

“President Obama’s attempt to go around Congress and the American people is at best unwise and possibly illegal,” he tweeted. “This is a classic Barack Obama move of choosing politics over leadership.

“This decision avoids dealing with Congress and the American people instead of fixing a broken immigration system once and for all,” he said on Twitter.

Rep. Allen West (R-Fla.) piled on, arguing that changes of such significance should require the approval of Congress.

“We have representative government,” West said in a statement, “and I think right now this shows that we're getting away from government that's based upon the consent of the American people, and we're starting to live under a rule by edict or executive order.”

The Department of Homeland Security (DHS) announced a new policy Friday allowing certain illegal immigrants who were brought to the United States as children to remain in the country. The beneficiaries will not be eligible for U.S. citizenship, but they would be allowed to work and would no longer be targeted for deportation.

“Our nation’s immigration laws must be enforced in a firm and sensible manner,” DHS Secretary Janet Napolitano said Friday in a statement announcing the policy. “But they are not designed to be blindly enforced without consideration given to the individual circumstances of each case.”

The issue has been big on the presidential campaign trail this year, with both sides vying for a larger slice of the ever-growing Hispanic vote.

The issue has been a tough one for GOP contender Mitt Romney, who tacked far to the right on immigration during the Republican primary and has since sought ways to soften his position without alienating the conservative hard-liners of his base, who consider anything shy of deportation to be amnesty.

To everyone.  It is one thing to vent here, but I suggest that you email your Congressmen and let them know how you feel about Obama's illegal actions.  I already have contacted mine. 
It appears to me that only a few of our lawmakers have openly spoken out against Obama's executive order circumventing laws already passed relating to illegal aliens. Now is the time for true Americans to speak out.

 If your parents robbed a bank and got away with millions of dollars when you were a baby, and you grew up reaping the benefits of that theft, good homes, good clothing, good medical care, good education, all paid for with the ill gotten gains of their actions...and they finally got caught when you turned 18......should you get to keep the money they stole? After all...it wasn't your fault they broke the law!
 
 Sorry, but I think not! It is not your fault, it is your parents fault. You should blame them and let the money go back where it belongs. In the case of stolen freedom....it is not your fault, but you should not continue to reap the benefits of their illegal actions. Lay the blame where it belongs, go back where you should have been raised and try to make the best of your life that you can. Indeed, given that you have already had the advantage of a good education, you should be able to do far better than your peers in that country!
 
 Reality: We all benefit, and lose, according to the results of our parents actions. When the parents do the right things, the children get the advantages. When the parents do the wrong things, the children get stuck with the disadvantages too. These kids parents made a bad choice, to steal freedom that was not theirs to take.
 
 My parents died young and poor, it had an affect on my life. I grew up in what would be considered less than ideal circumstances. If they had lived and made a lot of money I imagine my life would be considerably different. But I had to take what life dealt me and do the best I could with it. But their choices did not give me the right to take from others.
 
 Or maybe the nation owes me?

 Whether you are in favor of the policy or not, I can’t help but think about the train wreck this will be for LEOs in the field that have to implement it.  How’d you like to be a Border Patrol, CBP or ICE agent in the field trying to determine if someone here illegally meets the criteria to get to stay?  I know if I was a 16 year old from another country I’d be doing anything I could right now to get into the US and sign up at the nearest high school, it would be a home run.

So you give "amnesty" to 800,000 and give them job permits, where are they going to get jobs when over 8.2%( a very conservative number as we know it is much more than that)or unemployed in this country right now!
Just another example of disregard for the Constitution!

We are not a "nation of morals" for good reason, everyone has different morals. The Law is constant (or at least it's supposed to be) We are a "nation of laws" because morals differ. Examples anyone?



The interpretation of laws change because morals change. It has been stated in these forums that Obama has broken laws, peed on the Constitution, and has virtually become a dictator. As Americans, have our morals changed so much that we are afraid to hold him accountable for breaking laws by illegally selling guns to the Mexican Drug Cartel and at the same time laying out plans to take away the rights of honest, law abiding citizens by trying to go global with outlawing firearms using the UN.  Yes, we are a nation of laws but it seems that our morals dictate the enforcement and interpretation of our laws.
We have illegal aliens who have grown up in the United States who should have already been deported years ago.  Who has been supporting these people? You and me and every other taxpayer without our consent because we vote to have representation in Congress and they are not doing their job.
Now, we have a man who has visions of grandeur and no sense of responsibility who plans (by executive order) dump 800,000 illegal aliens into the already unemployed  or underemployed American workforce because it is the moral thing to do. BS

Athough Obama administration has deported more illegals than any other administration , truth is Neither party has ever really been serious about stemming the tide of illegals. Businesses won't have it. it would cut into their profits if they had to pay True livable American wages for the jobs most illegals perform.

If Gov ws truly serious , it;s easy enough to do , heavily (AND I MEAN HEAVILY) FINE ANY COMPANY WHO GIVES A JOB TO AN ILLEGAL. It's really that easy. But the corps and businesses would lobby hard against passage of any legislation along those lines . These corporate bought politicians all talk a good game , but no one truly wants to fix the situation.

You sure nailed that one right , if good old Un. Sam wanted to stop the flow of illegals , it would have been done already , 160,000 US Troops in the sand = South Texas , AZ . NM , and Southern Cal. somewere it would do some good !

Anyone who thinks we're talking only of about 800,000 kids brought here by their parents had better think again.  And anyone who believes that they only come here to do jobs that Americans won't do is sadly unaware of what is really going on.  It also does no good to blame employers; they are not the ones responsible for securing our borders and enforcing imigration policy.  Cut it any way you want, but it all falls on the illegal in the White House.  That is the case now and yes, it was the case when GWB was President and Clinton, and Bush and....

The fault (IMO) goes way beyond the current ruler in the Palace of the American King! It ultimately comes down to us! It's our fault the gutless criminals in the House and Senate are elected year after year.Most voters agree they do not represent their constituency, but we continue to elect them anyway. "After all"They are better than the opposition right?LOL! These people feed from the same trough. If we had Constitutional representatives in Congress, the figureheads in the WH, would be just that!They would have very little power.

We still have the power at the polls to send someone new to DC every election year, to prevent them from becoming bought and paid for, and we choose not to!We the people are reaping what we have sown.IMO, we are aiding and abetting.
