  Autopsy: Border Patrol agent fired gun 10 times, killing driver 1 day ago By Elliot Spagat  He fired through the windshield as he clung to the hood of a car driven by the victim after she hit him and drove 200 yards. SAN DIEGO — A Border Patrol agent in Southern California who shot and killed a mother of five after she hit him with her vehicle fired his gun 10 times from the hood of her car as he tried to get the woman to stop, according to an autopsy report released Thursday.
Valeria "Munique" Tachiquin Alvarado, 32, suffered 14 gunshot wounds to her upper body, the San Diego County Medical Examiner said. Some bullets may have caused more than one wound.
The autopsy determined the Sept. 28 death was a homicide and lists multiple gunshot wounds as the cause.
 
Alvarado fled a friend's apartment in Chula Vista when agents came with an arrest warrant for someone else, according to the autopsy, mirroring previous statements from police. Police say her car struck an agent and she drove with him on the hood for about 200 yards.
The agent held on to the Alvarado's 1994 Honda Accord after breaking the windshield, firing his pistol until she stopped, the autopsy says.
 
Alvarado's blood tested positive for methamphetamine at 0.1 milligram per liter.
Alvarado's family has filed a wrongful death claim against the Border Patrol, saying the agent who fired had a long history of misconduct in a previous law enforcement job and should not have been on the job. Documents released by family attorney Eugene Iredale say the agent, 34-year-old Justin Tackett, was suspended four times for misconduct including crashing a patrol car and violating suspects' rights in the nearly four years that he worked as an Imperial County sheriff's deputy.
 
A Border Patrol official said on the day of the shooting that the agent feared for his life. The National Border Patrol Council, the union representing agents, has said it is confident he acted properly.
 
The Border Patrol has been involved in a series of deadly shootings along the U.S. border with Mexico, and the Homeland Security Department's inspector general is reviewing the agency's policies on use of lethal force. The ACLU Regional Center for Border Rights says agents have killed at least 18 people since 2010.

  I remember when this happened we talked about it then. 
 
  Now that more facts are out I'm less inclined to see it as excessive.  It's not like she accidentally hit the gas and he shot her.  She was high on amphetamines which likely contributed to her not doing the smart thing (hands up, shut up, lawyer up) and instead went for the Hollywood movie/video game solution of running him down.  Maybe he's not an ideal law enforcement officer by his nature, that doesn't mean he was wrong in this case.

The drugs were probably the reason she could drive after beig shot that much----maybe it was partly due to being shot by a 9mm----em--if that was what they carry.

With him on the hood, and her refusing to use the brakes, she deserved to be shot.  Why did she run to begin with?

Ok, you are the officer. You're on the hood clinging for life. The driver is high and out of control. What the heck would you do? Personaly, I'd have fired till I was sure the driver was no longer a threat and with someone high on drugs that generaly only occurs once they are dead! She made her choices and the same as anyone one had to face the consequences. If only one got to go home to their family I'm glad it was the officer. His past record has absolutely nothing to do with her making him a hood ornament! Heck, were I him and they asked why I fired 10 times you know what my answer would be? Because that's all my gun held!

SH. Good post Sir. Several years ago a punk was killed in Lou by city cops. One was asked why the punk was shot 18 times, he said, we ran out of ammo. POWDERMAN.

I read the article and had to slow down because it didn't make sense. First, it identifies the hit and run driver as the victim, and then it says it's being treated as a homicide. I don't understand these characterizations.


A cop gets hit by a car, he's hanging on for his life, and he's the bad guy?


Conceivably so, perhaps if he fired the shots and then the car rolled to a stop 200 yards away.

This is exactly the reason that the past is not allowed in most courts--the incident is the question.

I would have done the same thing as the officer did. She was in the wrong all the way.
