Hasan’s beard is not just facial hair; it is a statement. And it is. Hasan grew his beard because of his Muslim faith? He murdered thirteen people because of his Muslim faith -- by his own account. Under these circumstances, he should not be given any accommodation for his religion.

FORT HOOD, Texas (AP) — The Army psychiatrist charged in the deadly Fort Hood shooting rampage apparently will be allowed to keep his beard during his military trial, after a new judge indicated Tuesday that she won't force him to shave.
 
The previous judge's order requiring Maj. Nidal Hasan to be clean-shaven or be forcibly shaved before his trial had tied up the case for more than three months, but an appeals court ousted that judge earlier this month.
The new judge overseeing Hasan's case told him during a hearing Tuesday that the beard, now thicker than when he first appeared in court with it in June, violates Army regulations. The judge, Col. Tara Osborn, said she won't hold it against him but that military jurors might.
Hasan answered "yes, ma'am" when Osborn asked if he grew the beard voluntarily. In a previous court hearing, he said he grew the beard because his Muslim faith requires it and not as a show of disrespect. Osborn asked defense attorneys to draft jury instructions about the issue. Jurors likely will be told not to consider Hasan's appearance when deciding on a verdict.
 
Hasan, 42, an American-born Muslim, faces the death penalty or life in military prison without parole if convicted in the 2009 rampage that killed 13 and wounded more than two dozen others on the Texas Army post.
Osborn was appointed to the case two weeks ago, after the U.S. Court of Appeals for the Armed Forces removed the former judge and tossed his order regarding Hasan's beard. The ruling said Col. Gregory Gross did not appear impartial while presiding over Hasan's case and that the command — not a judge — is responsible for enforcing military grooming standards....

The way I read it is that the judge said it's not the role of a judge to enforce the grooming standards, but it is the responsibility of "the command", which in Hasan's case, I assume is the commandant of his prison.

He may need to keep playing the beard card to get a better sentence. Note that when this first happened there was some doubt that it should be considered a terrorist attack. The alternative is that he's a nut case that killed a bunch of people to avoid shipping out. Military justice has a very refined process for handling the nut cases. But terrorists in their ranks are not as well understood. My guess is that he's doing this as an act to make it look like he's a terrorist. Here's a quote from the time:

apply the standards they would and have many times to any other soldier. forcibly shave him do not coddle him or make exceptions just for him.

he committed his crime, and that
this was to be a military trial.
if that is the case, i guess it's
good that i'm not in charge of the
deal. he'd be shaved if i had to

of m.p.'s in to restrain him, and he'd
be properly dressed in uniform, shoes
shined, clean-shaven, and standing
at attention before the court on the
appointed day at the appointed hour
to the minute.
public opinion shouldn't have any bearing

I've got a rusty bayonet that could shave him as good as a scythe or guillotine. He was clean shaven when he killed the soldiers and he was a muslim at that time. Hold him down and use a weed wacker on him.

It is not the military courts job to shave him. It is his parent commands responsibility to ensure he is in the proper uniform. His parent command obviously doesn't care about uniform standards or professionalism. Beard or not he with malice aforethought murdered fellow US soldiers. The evidence is overwhelming the trial should move forward and let the court martial panel decide his fate. The Army should quit screwing around and get on with it.

 Back in May, '73, trying to get home for my discharge from the Army, I spent over 36hrs in Rheine Main AFB on standby for a flight. Every morning at 5:00 AM the MPs came along and made us all go shave! We were all in uniform ( over 60 of us had collected by then, all waiting for a freedom bird) and none of us had a choice. Just saying.
 Personally, I don't care if the guy is shaved or not, he is a Traitor, clean shaven or grubby. If "this" guy doesn't get the death penalty, then who would? Oh yea...maybe those guys who urinated on the dead bad guys in A-Stan!?

we just keep bending the rules to make sure we are pc. the rest of the men and women certainly take notice of these exceptions. this among the many misguided changes brought on by obama beliefs has and will continue to break down discipline within the ranks. attacking the military from without spelled political doom so they started working on its destruction from within.
