Three suspects charged with helping marathon bomber hide tracks  Published May 01, 2013

Three new suspects have been charged in connection with the Boston Marathon bombing, two for conspiring to get rid of their friend's incriminating backpack filled with gutted fireworks after learning he was a suspect in the April 15 terror attack, and another for lying to investigators, according to an FBI affidavit released Wednesday.
 
Dias Kadyrbayev and Azamat Tazhayakova both 19-year-old natives of Kazakhstan and friends of Dzhokhar Tsarnaev at UMass-Dartmouth, allegedly went to Tsarnaev's dorm and took a laptop, the backpack and some Vaseline that may have been used in making the deadly pressure cooker bombs that killed three and injured more than 200 at the race. Police believe the bombs were packed with shrapnel and gunpowder removed from fireworks.
Robel Phillipos, of Cambridge, Mass., also 19, was charged with willfully making materially false statements to federal law enforcement officials during a terrorism investigation.
The affidavit filed in support of a complaint said Kadyrbayev was the one who carried out the disposal of the backpack after the three saw the fireworks that had been hollowed out and emptied of gunpowder.

The three acted on April 18, three days after the bombing and hours after investigators aired surveillance footage identifying Tsarnaev and his older brother Tamerlan as the suspects in the bombing, though not by name, according to authorities. Phillipos first saw footage depicting Dzhokhar Tsarnaev on the news Thursday, and told Kadyrbayev over the phone that he suspected their friend was the bomber. When Kadyrbayev later texted Tsarnaev and said he bore a resemblance to the subject of an intense manhunt, Tsarnaev allegedly sent back a chilling response: "Lol, You better not text me." He also texted Kadyrbayev to say, "Come to my room and take whatever you want," according to the affidavit.
 
The exchange came just before 9 p.m. on April 18, a few hours before the Tsarnaev brothers would carjack a Chinese immigrant, murder an MIT police officer and engage in a wild shootout with police through the streets of Cambridge and Watertown, police say. Tamerlan Tsarnaev died April 19, after a shootout hours after authorities showed the brothers on surveillance video and named them as suspects.
 
Although the three new suspects initially appear to have stonewalled authorities, Phillipos came clean in a fourth interview, conducted April 26. He confessed that the three took the backpack out of their friend's dorm room, according to the affidavit. Phillipos allegedly told investigators that the two others "started to freak out" after seeing Tsarnaev identified on television.
 
Robert Stahl, an attorney representing Kadyrbayev, said his client denies the allegations and added that Kadyrbayev assisted authorities in their investigation.
"He is just as shocked and horrified by the violence that took place in Boston as the rest of the community is," Stahl said. "He did not have anything to do with it."
Prior to the latest development, authorities had named only the brothers as suspects in the bombing at the finish line of the world-famous race.
Kadyrbayev and Tazhayakov face maximum sentences of five years in prison and fines of $250,000. Phillipos, a U.S. citizen, faces a maximum sentence of eight years in prison and a $250,000 fine.
 
Kadyrbayev's attorney, Robert Stahl, says his client will be transported to the federal courthouse later Wednesday to appear on new criminal charges. On Friday, Yerlan Kubashev with the Consulate General for Kazakhstan in New York confirmed in a statement to Fox News that the consulate is helping the young men with legal representation. Both Kadyrbayev and Tazhayakov will plea not guilty, according to their attorneys.
Kubashev said the two men are "shocked at the bombings," and "they express sorrow to the bombing victims and their families."
 
Dzhokhar Tsarnaev, 19, is in a prison hospital after being wounded in the shootout with police as he and his brother made their getaway attempt. He is charged with using a weapon of mass destruction to kill, a crime that carries a potential death sentence.
Authorities have searched the Rhode Island home of the parents of Katherine Russell, Tamerlan Tsarnaev's widow.

remember, folks: the feds are allowed to lie to you, but if you do it to them - for whatever reason? - you're going to get jacked up on felony charges.

WASHINGTON –  One of three college students arrested Wednesday in the Boston Marathon bombings case was allowed to return to the United States from Kazakhstan in January despite not having a valid student visa, a federal law enforcement official told The Associated Press.
 
Authorities charged the student -- a friend and classmate of one of the men accused of setting off the deadly explosions -- with helping after the attacks to remove a laptop and backpack from the bombing suspect's dormitory room before the FBI searched it.
The government acknowledged that U.S. Customs and Border Protection was unaware that the student was no longer in school when he was let back into the United States.
The disclosure was another instance of possible lapses by the federal government in the months before the Boston bombings. The Obama administration earlier this week announced an internal review of how U.S. intelligence agencies shared sensitive information and whether the government could have disrupted the attack. Republicans in Congress have promised oversight hearings starting next week.
 
Federal authorities on Wednesday arrested three college friends of Dzhokhar Tsarnaev, a bombing suspect, including Azamat Tazhayakov, a friend and classmate of Tsarnaev's at the University of Massachusetts Dartmouth. Tazhayakov left the U.S. in December and returned Jan. 20. But in early January, his student-visa status was terminated because he was academically dismissed from the university, the official told the AP.
The law enforcement official said information about Tazhayakov's status was in the Homeland Security Department's Student and Exchange Visitor Information System, called SEVIS, when Tazhayakov arrived in New York in January.
 
The official spoke on the condition of anonymity because this person was not authorized to discuss details of Tazhayakov's immigration history.
DHS spokesman Peter Boogaard said when Tazhayakov arrived on Jan. 20, Customs and Border Protection officials had not been notified that he was no longer a student.
Boogaard said in an emailed statement that DHS had recently reformed the student visa system to ensure that CBP would have access to all relevant student visa information. Later, however, he clarified the statement to say that the reform was ongoing.
"At the time of re-entry there was no derogatory information that suggested this individual posed a national security or public safety threat," he said.
 
Tazhayakov and another student from Kazakhstan, Dias Kadyrbayev, were detained last month on immigration charges. They were arrested on federal criminal charges of conspiracy to obstruct justice. Robel Phillipos, 19, was also arrested and charged with willfully making materially false statements to federal law enforcement officials during a terrorism investigation.
 
Questions about Tazhayakov's immigration status came up Wednesday during an immigration hearing in Boston when a judge questioned how he was able to return to the U.S. in January. A lawyer for Tazhayakov said he had re-enrolled in the university with a different major after returning to the country.
International students who aren't enrolled or are dismissed from a college or university generally have 30 days to rectify their status and re-enroll as long as they are already in the United States.
 
Lawmakers have questioned information sharing among U.S. law enforcement before the bombings. In 2011, Russian officials notified the FBI and CIA that they were concerned about now-deceased bombing suspect Tamerlan Tsarnaev. In early 2012 Homeland security was alerted of Tamerlan Tsarnaev's travel to and from Russia -- information that was shared with Boston's joint terrorism task force. But the FBI investigation into him had closed and therefore he didn't warrant additional scrutiny, officials have said.

Sounds more like they were just freaking out over being associated with the two brother bombers. No different from the '70s--- when someone in the dorm got busted, everyone got rid of their stash. Maybe not, but Kazakhstan does not have a history of terrorism. It's not like our law enforcement knows the difference between central Asia and the Middle East...

I get that an important part of your schtick is to be contrarian for it's own sake.  Sometimes I think there is some value there.  But if you destroy your credibility by taking absurd positions just for sake disagreeing with others, the impact when you actually have something of substance to add will be diminished. 
 
What at least some of those arrested are accused of is deliberately removing evidence relating to the bombs.  That is not just, "lying to the feds".  It is not close. 
 
They may not be guilty.  We're only a week removed from the Feds ricin case falling apart after they apparently fingered the wrong guy.  Or they may have done exactly as is being reported.  Time will tell.  Still, they are being implicated in something much more serious than merely lying to investigators.

And some believe the Tasrnaev brothers were set up as scape goats. Perhaps this is just another wild conspiracy theory but the way our government's story leaves so many unanswered questions does give play to any theory which appears to answer some of those questions.

True, and I'll not argue otherwise... but one of them was charged with lying, as I understand. Whenever I hear of that happening, I narrow a jaundiced eye, and take a big dose of salt,  because that sometimes - oftentimes? - means the Feds are pissed, and decided to show who's boss. They're gonna convict that ham sandwich, dammit. That ought to bother everyone.

Here's something - and it might turn up here, who knows? - it's possible that the brothers were egged on by some FBI plant who was looking to gather evidence for a dramatic busting of a terror plot. It's happened before.

Interesting insight from this is that explosive could have been taken from commonly available fireworks.

 So I think it best to sit back and watch . What's legal or not as applied to the feds is the law if we agree or not it's the law we live under so failing to comply is a crime. The three new suspects and innocent until proven guilty . We should obey our own laws or they will be useless for even our use in the future. If they are guilty of a crime or several I hope they are convicted to the fullest of the law.
 Now what might be proven is a connection to what I am not sure maybe off shore interest wanting to harm America. The idea of cells might be proven . This might be just kids helping friends or much deeper. To speculate is a waste of time.  But at any rate better to take it slow and get all the evidence and leads correct the first time.
