BERLIN –  A 93-year-old man who was deported from the U.S. for lying about his Nazi past was arrested by German authorities Monday on allegations he served as an Auschwitz death camp guard, Stuttgart prosecutors said.
Hans Lipschis was taken into custody after authorities concluded there was "compelling evidence" he was involved in crimes at Auschwitz while there from 1941 to 1945, prosecutor Claudia Krauth said.
 
Lipschis has acknowledged being assigned to an SS guard unit at Auschwitz but maintains he only served as a cook and was not involved in any war crimes.
Krauth said, however, that a judge upheld her office's request for an arrest warrant after concluding there was enough evidence to hold him before charges on accessory to murder are brought. Bringing formal charges, a process similar to a U.S. grand jury indictment, would take another two months, she said.
In the meantime, Krauth said a doctor has confirmed Lipschis' health remains good enough for him to be kept in detention.
Lipschis does not currently have an attorney, and a public defender has not yet been appointed, she said.
 
Lipschis was deported from the U.S. in 1983 for lying about his Nazi past when he immigrated to Chicago in the 1950s after the war.
With no evidence linking him to specific war crimes, however, it was impossible under previous German law to bring charges against him in Germany.
But the case is now being pursued on the same legal theory used to prosecute former Ohio autoworker John Demjanjuk, who died last year while appealing his 2011 conviction in Germany for accessory to murder on the grounds that he served as a guard at the Sobibor death camp.
Under the new line of thinking, even without proof of participation in a specific crime, a person who served at a death camp can be charged with accessory to murder because the camp's sole function was to kill people.
 
Even though the Demjanjuk conviction is not considered legally binding because he died before his appeals were exhausted, the special German prosecutors' office that deals with Nazi crimes has said about 50 other people in the same category are being investigated.
Efraim Zuroff, the chief Nazi hunter with the Simon Wiesenthal Center, called the Lipschis arrest a good start.
"This is a very positive step, we welcome the arrest," he said in a telephone interview from Israel. "I hope this will only be the first of many arrests, trials and convictions of death camp guards."
 
In an interview last month with Die Welt newspaper at his home in southwestern Germany, Lipschis said he spent his entire time as a cook and had witnessed none of the atrocities. He did say, however, that he "heard about" what was going on.
About 1.5 million people, primarily Jews, were killed at the Auschwitz camp complex between 1940 and 1945.

How many Soviet guards are they going to arrest?  Remember, you also had a Gulag, Ukrainian and Armenian genocide.  I guess that means the 98% need to have a strong lobby.
Study after study has shown how dangerous distracted driving is yet people continue to talk on their cell phones while driving. Driving in the U.S. requires your full attention. Many states and countries have made it illegal to use a cell phone while operating a motor vehicle and the federal government should follow their lead. Banning the use of cell phones while driving would have the added benefit of making the no-texting law enforceable.

How are they going to investigate a crime that happened over 60 years ago? Where is the evidence? Where are the witnesses? It all sounds like a bunch of hearsay. I thought that whole Demjanjuk conviction in a German court was a sham. The Israelis tried him and did not convict him in the 80's. If anyone had an axe to grind it would be them but they set him free. This "special" German prosecutor for NAZI war criminals reminds me of McCarthyism.

Demjanjuk was on death row for 6 years.  You call that freedom?

In the meantime, we don't see much in our fair and balanced media of where Netanyahu visits.  We know who runs the media in America.  But isn't China a big concentration camp?  How many victims were there in the blood soaked regime?  That is some kind of supremacism, isn't it?  Complaining about what happened in the '40's, but what about the 50's, 60's, 70's, 80's.....?

They are gonna try a 93 yr old man? You got to be kidding. Sounds like a lot of money to spend on a guy that could die any moment. Does he even know why he's in trouble? You get old and memory fades. If I was his attorney I think I'd plead innocent!

They turned him loose didnt they? His conviction was overturned. Obviuously there wasnt  enough to uphold his conviction. He goes free and back to the US. A few years later here comes another bunch with accusation of him being a war criminal and they shuffle him off to yet another country to be tried for war crimes. It all sounded like a bunch of bull to me. I dont know of his citizen status at the time of the second accusation but what ever happened to double jeopardy? Does that not apply to him?

Double jeopardy doesn't apply to hate crimes and anything that has to do with Jews seem to be automatically elevated to that Status.
 
This old fart they got in Germany now makes good propaganda and is another way for Germany to kowtow "me real bad" to Jewish interests.
 
As horrific the 3rd Reich period was it handed Jewry a great big advantage/favor by giving them the biggest "Victim Card" ever and they play it well and probably for decades to come.Meanwhile back in their lair they run a KZ of their own.
