In Texas deadly force is legal anytime in your home or yard, and defending property after dark.

Only problem i could see if it happened today is if the person was black! But the chances of that happening here is right up there with a lion attack in my back yard. Probably 5 black familys within a 150 miles of my house. Most blacks are driving way up here to steal a car or break into my house.
