Burglars Killed In Self Defense Shooting

Third Suspect Still On The Run


March 7, 2004

SACRAMENTO -- Police have no plans to arrest a Sacramento man who fatally shot two intruders who were trying to break into his son's store early Saturday morning.

Chong Her was camping out overnight in his son's small Southeast Asian market in Sacramento when two men jumped into the building and rushed toward him.

Her fired two shots. The men were dead shortly after 3 a-m.

Chong's son, Bee Her, says his 67-year-old father had been sleeping in the store since a burglar broke in through the roof two weeks ago.

Police say they have no plans to arrest Her because he was firing in fear of his life.

Officials say Her saw a third person's legs dangling from the store's air conditioning vent, but that person disappeared.

I agree that the two bad guys got what they had comin' to 'em.  But with the way things are today (especially here in Caliban), I'm a little surprised the police aren't charging the store owner's father with anything.  If he was sleeping in the store with a gun because someone broke in two weeks ago, isn't that considered 'lying in wait'?

I also think the store owner should be ashamed of himself, for letting his 67-year-old father take the risks and do his dirty work for him. :noway:

I wonder how he would feel if the bad guys got away and his father was the one that was killed...

Dali Llama say he have no problem with man "lying in wait" after store robbed in past; Dali say ancient Tibetan proverb state once bitten, twice shy.  Dali say perhaps store owner had to work another job or have other commitment that particular night. :D

I couldn't agree with Dali more. Its about time we take the gloves off!!!

We had three thugs break in to a mans apartment last week. Old boy let loose with a 20 gauge. He got one of them in the leg I think. The other two dropped him off at the hospital and left only to be arrested a little while later. They wanted the guy that shot them arrested. Can you believe that. The police said no way, you broke in to his apartment your lackey to be alive. No charges were filed against the shooter :-D .

One thing I can say about Central New York is they don't really give "home owners" a hard time about using force of any kind when somebody 'intrudes" your home. The laws in New York don't give you the right to shoot someone just because their in "your" home (all though it should) their suppose to be some kind of threat (if you can believe that) then you can use force. The DA will put the home owner (shooter) in front of the grand jury (he has to) and be real sympathetic to the him or her. And nobody wants to let someone else break in and torment someone. If the grand jury drops the charges then the DA did his job and everybody happy and the right people are dead!!! :-D

Probably wanted him arrested for creating an unsafe workplace for criminals.

Noting the name/culture, I think this was a way for the father to feel useful and contribute to the overall security of the family and their business. And I'll bet the father volunteered for the duty. He may not be abe to "tote that barge and lift that bale" anymore, but he can sure protect the families assets. Good for him.
