Any marks on the brass?  How many rounds did you have in the magazine.  Is it as hard to operate with 1 rounds in the mag as it is with 3????  Is it difficult the entire operating length, just at the begining or just when the bolt is over the magazine.  Remember, the bolt wheb fully withdrawn is not over the magazine.  It's behind the mag...  Is it still stiff there...  We're gonna have to get more info!!

after messing with it for over a hour this is what I have came up with:

the gun feeds just fine, the problem is the bolt will not close all the way without force. does not do this all the time but about 80% of it.
I have tried two different factory ammo and my reloads, bolt still wont close all the way. There were some makes in the bullet thats why I thought the bullets were to long.

Let's see the rifle feeds OK but is difficult to close.  It leaves marks on the bullets, not the brass.  There is not such problem when there is no round in the chamber.  Sounds as if the chamber was cut without a throat or with a very shallow throat.  If it does this with 80% of the factory ammo then you certainly have a problem.. one that can only be remedied by a competant smith or the factory.  Sounds to me as if you found the reason the rifle was 'used but like new'.  I would take it back to the dealer I bought it from and ask that he send it back to Winchester.  You could also just give Winchester a call at- (800)945-1392.  This is the Browning / Winchester service Department.  I have had good luck with them, within the guidelines they are given.   At first I thought perhaps a headspace problem but the marks on the bullet indicate it had engaged the rifling.  Since this is factory ammo that should not happen.  I am assuming you've cleaned the rifle thoroughly and there is no rust in the bore or throat..  since the rifle is so new I'd be inclined to let Winchester handle their own bobble..  A gunsmith may well charge a fair amount for cutting a throat in the rifle that should have been there from the factory..

Not trying to insult you.  May double check what caliber is stamped on the barrel.
