Shipping an Encore

can anyone tell me how they ship their Encore firearm between individuals in different states. I sold mine and called around and UPS said they would ship ground. Now they tell me I cannot ship to an FFL unless I am a FFL myself. Is it so bad now that an individual cannot ship a firearm anymore? Is this a gray area that people are afraid to ask? I know this is classifieds but I was wondering how most people shipped their firearms when they sell, do they do individual to ffl or ffl to ffl only. I am shipping from an individual to an FFL in another state. What carrier do you use and has anyone else ran into problems?

Rifle or Pistol.  Rifles can be sent by FEDEX or mail by USPS. Pistols are a different story and can be sent by FEDEX or UPS overnight delivery but this gets quite expensive.

Fedex said no matter what kind of firearm I had to ship overnight. Does it depend on who you talk to? UPS I called three times and got 2 answers, so I called the ATF and checked the current law. I can ship to an FFL, my question is, are the shippers going by corporate rules that they just set (because of liability and theft) and do not change unless mandated by law or do they change their rules to follow the law however often the law may change? It is a rifle by the way.

The ATF said the USPS will not ship but only from FFL to FFL anymore. And that is the answer I got from UPS from the second two people I talked to. I guess it may be a dont ask dont tell policy as long as you are following the law? I am just curious how others are shipping since this is the first and maybe the last since options are low and it depends on who is working the counter. Thanks for the input and I hope more will answer.

USPS will ship( LONGGUNS only), from an individual to FFL  as long as you fill out the form ( PS 1508) that tells them that it is going to an FFL.

And it is relatively inexpensive to boot.

On the other hand USPS only allows FFL to FFL for handguns, and it also pretty cheap.

At any rate, no matter how you send it, it HAS to go to an FFL if it is going state to state

I will have to try the USPS again if the need arises. I called and the post master of the city I live in said no at first then said he would have to check out their latest policy when I asked why. He called back and said under no circumstance will they ship from an individual. Guess it is who you talk to. Thanks for the input though, the more posts I get the more knowledge I can take and can possibly even get them to ship, such as the form you talked about. The postmaster never mentioned anything like that and told me that I was not allowed in the building with a firearm.

It is a violation of Federal law (GCA 1968) to ship ANY firearm to a resident of another state without going to a dealer in the state where the new owner resides.  This is a felony violation and is not to be trifled with.  An FFL dealer CAN accept a firearm FROM an individual, but many choose not to, and there may be State requirements that prevent it in some states.  DON'T let an unknowing clerk in a shipper's office tell you it is all right, as the violation will be yours.  The logic to this is to allow the dealer in the state where the gun goes to enforce the local requirements for the person who receives the gun.  This is my two cents based on the past 26 years in law enforcement and 15 years with a second job in a gun shop.  Feel free to check further if you doubt.

It makes snese that I would need to ship to an FFL who is in the state of the reciepient, but why would it need to come from an FFL? It's like saying people in the U.S. are not competent enough to handle their firearms.

Lest you forget you are trying to make sense of silly laws.

We can only ship handguns from FFL to FFL  because ATF says so, which is the same reason that it is permissable to ship longguns from an individual to an FFL, that what ATF says.

That is what I have also found out. I have a red and green book from the ATF that has the fed laws and the 50 state firearms laws listed and what they state. You can contact your local ATF office as they should have them. A handy tool to try to remain legal in transfer, transport, and anything you may do that involves firearms. Just thought that people may use that little tidbit of info.
