I hope they hang the bastard, there is no way this should of happened. Hunters making sound shots will they ever learn.  This could happen to anyone of us too.

I pick blue berries up there every year I was just up there a few weeks ago above Rutland picking blue berries.  I'm getting ready soon for my annual fall foilage/ bear hunting trip too.

Gilbert, 26, of Charlemont, Mass., pleaded innocent to a felony charge of second-degree murder and was held on $25,000 cash bail following the arraignment. He faces the possibility of life in prison if convicted.

Thirteen steps up and a long drop on a short rope is too good for Gilbert.  Something more in the line of a slow broil over a brush pile comes to mind.  Second degree murder - should be First Degree with a stupidity charge added.  $25,000 is the crowning joke to this horror story.  $25,000,000 is more like it.

BigBill,

How about keeping up on this story and let us know what the guy gets?

Wow guys.  I hope everyone that has responded so far lives perfect lives.  The old saying is that two wrongs don't make one right.  It sounds like the older gentleman picking berrys was old enough to know about hunting season.  I don't go in the woods here in Wyoming this time of the year for any reason without some orange on.  And of course, you shouldn't shoot what you can't see.  Neither of them acted prudently.  I agree with killing Brian though.  I think he should be stoned to death by all of you who have never done any wrong.

Made a huge mistake that took a man's life...and then he walked away.  Throw the book at him.

Was not there therefore I can't judge the shooting.  Him leaving was wrong maybe, but I can't judge that either since I was not there and don't know the whole story.

I almost shot a woman a few years ago, that was picking berries.  She was wearing a fur parka.  Beaver skin, same color as a grizzlie bear.  She was down on allfours picking blue berries, in the same meadow where I had shot a Black Bear the evening before.  Yes native women do wear fur coats while doing things outside in the interior, it's the only coat they usually have.  Luckily I was not in a hurry and wanted to get a better look before shooting.  She stood up then and gave me a good look at her face.  I got so scared when I realised how close I had come to shooting this woman.

I went and yelled at her husband, told him how close I had come to shooting his wife.  His comment: "Shoot the _____ I told her not to wear that coat!"  And he walked off.  Therefore I don't always blame the shooter, sometimes the blame can lie with the person that got shot, and the shooter is the victum.

Not saying that about this case, just that we don't know all the facts.  I can't pass judgement.

What Is A Veteran?
A 'Veteran' -- whether active duty, discharged, retired, or reserve -- is someone who, at one point in his life, wrote a blank check made payable to 'The United States of America,' for an amount of 'up to, and including his life.' That is honor, and there are way too many people in this country today who no longer understand that fact.

Gilbert's statement to the police said,

Quote
Gilbert later told police that before he fired, he heard what sounded like a bear and thought he saw the animal's head lift up in the vegetation and sniff the wind, according to court documents.

which means he took a sound shot.  Do you shoot at sounds while hunting?  A felony charge of second-degree murder and $25,000 cash bail is a slap in the face of all hunters and the family of Douglas Bartlett.  Life in prison without the possibility of parole would be more like it.  Lawdog

First he was guilty of poor judgement and he will pay for that the rest of his life not matter the outcome of the trial, but leaving the scene and not call for assistance is a deliberate decision that makes him a murderer in my book.
