1st question: What kind of rifle.
Depends upon the action, barrel dia & shank.
The .440-40 is basically a pistol cartridge, whereas the .44-77 Rem is a large rimmed case rifle cartridge.
Give more info & then we might be able to better answer.

Sherrpa: something else to think 'bout
If the barrel shank/dia is large enough to rechamber to fit the .44-70 Rem (rim dia .625"; head/base dia. .516), you are also going to need the bore opened up & re-rifled.
The .44-77 Rem bore is .446 +/- ; .44-40 is approx. 427"
