Concealed?? Carry
« on: October 01, 2005, 03:15:09 PM »
Although NYS is a concealed carry only state, is there anything in the regs that state you must conceal a handgun while using it for hunting purposes?

I often deer hunt using my T/C Encore, 7mm-08 with a 15" barrel and always carry this on a sling outside my hunting coat.  On two different occassions I was asked by DEC law enforcement officers to see my pistol permit and hunting license and one time a NYS Trooper also asked to see the pistol permit.  All three times my T/C was hanging on the sling and loaded.  None of the three men ever commented on any failure to conceal the handgun.

Just curious.

Nothing that I see in the reg's against open carry.

No problem with open carry while hunting according to the Onondaga County pistol licensing officer, and my local DEC law enforcement officer. I personally contacted both recently to ask that very question.

Good luck this season.

I've had a Contender for almost 20 years and always carried it on a sling outside of my jacket. Our friendly DEC officer just so happens to like the road I hunt on so he's around a lot. Over the years I've been confronted by him and he never said a thing about the Contender being out in the open. He's asked to see my hunting license a few times but never asked to see my pistol permit. So its ok with him, he always went by the book.

It is one of those gray area that is not really outlined in the regs.  I would follow up with your local DEC officer or office to see what they think.  I carry open when hunting with my Ruger SBHH 44Mag but I always conceal my 9mm or 40 cal when carrying while small game hunting with my 22lr.  I guess it all depends on how much of a jerk the officer wants to be.

Crazy isn't it !
When I first got my permit (about 1972) we were REQUIRED to wear our short guns in plain sight..NO concealed carry..
Made sense..any lawman that you come in contact with KNOWS you're armed..
Also he can have a reason to check your permit..

Suddenly it seems, we must hide our weapons.

Has anyone ever heard a sensible reason why we must go concealed ?

   I can't think of any...

Should be your choice.  of course requiring permits for carry should be illegal. IMHO.

It depends on where you are at. In the field out in the open is fine but around the public I was told it makes people feel uneasy. I can actually vouch for that explanation. I was in a restaurant one time and some fellow was in there walking around with a pistol on his side. I think this guy was probably law enforcement. Just the same the gun was noticable and I could see that it made everyone that saw it nervous.

Airedale..
   That's the part I don't get !
Somebody hiding the fact that he is armed bothers me a lot more than seeing someone being honest and open about it..
I suppose that in this age of "political correctness"  when "feeling" replaces thinking...we must expect such silliness.

My fear if carrying open would be for some anti to file a false claim that you were intimidating or threatening them.  Just think what the outcome could be, and the cost of an attorney.

My fear of carrying open is I don't want some knuckle head hitting me over the head from behind or when I'm not looking and taking my pistol. I don't care who you are.......you can't see all 360 degrees around yourself "ALL THE TIME", you hear about it happening to LEO's from time to time. I always want to hold the trump card. The only people that know I'm carrying are the people I want to know, my wife, maybe my daughters, my dad. If I'm going to ride in a friends (or anyone elses for that matter) vehicle I'll tell them so there won't any surprises if we ever get pulled over. This is just my opinion!

I forgot to say that when I'm in the woods cutting wood, riding my ATV's or hunting I'll carry open. I don't have to worry about anyone else!

I suspect most of us are carrying pistols in NY on a carry conceal permit, which does not allow one to legally carry the pistol openly-though I never heard of anyone being given a hard time about carrying open while in the field hunting.

I can post the statute if anyone is interested.

Since YOU couldn't catch me.....ya it was me! Funny thing is when I was a kid my friend use to ride his three wheeler all over Eastwood. He would get chased out of Sunnycrest Park (Henninger), Huntington, Norwood Park, Cummings Field and the old Eastwood Jr. High school by the police all the time. I didn't dare ride mine fourwheeler on the street, getting caught by the police would have been the least of my problems.....my father would have kicked my @#$ :-D    :)

I am not a liberal nor do i care about "feeling" much.... but when someone is carrying a pistol on their belt they are infact "displaying a monopolizing instrument of force with the specific intention of showing authority and power over all those around them".... this is why a police officer carries a pistol... he is stateing " dont mess with me and do as i tell you or i may use deadly force upon you" .....just imagine what you would think if someone had that phrase printed on their shirt and was walking around a store or other establishment.  I know that most of us are respectable and respectfull of everyone around us, but when we are walking around packing on our hip, many of us do get a little more cocky and walk with a little more authority! ..... Many people would find it difficult to even think about disagreeing with someone who has a cannon strapped to their leg! P.S. anyone who carrys a pistol to intimidate or show power should not have one.

Carrying
« Reply #18 on: January 20, 2006, 04:49:50 PM »
I carried open and concelled for 25 years back in NY.  It is your right to do so.  I was asked for my permit only a couple of times.

Police officers that know you have a conceled carry permit actually feel safer because you have been to a class, your finger prints are on file in three places and usually criminals don't do any of these.

Stopped once on a very rural road late at night in Northern NY:  I opened my window, turned on the inside light, turned off the vehicle, and placed my hands on top of the wheel before the officer got to the car. As soon as he got there I stated: Officer,I have a legally licensed handgun between the seats and I am informing you of this for your protection.  He said thank you, can I see you permit.  I showed it to him. He asked if it was loaded, I said yes. He told me I had a parking light that was out and needed to get it fixed.  I thanked him for letting me know and I was off.

There is no restriction in NY, unless done so in the past 5 years, on carrying openly.  At one time there were three classes of carry: to the range only, open and concelled.

DCNewYork...I agree with this part of your post...That's about it though.

A Police Office carries a pistol because it is a tool of his/her trade.  He is only going to use deadly force on someone who deserves it and when the situation deem sit necessary.  I have never felt intimidated by a LEO because he or she is carrying a pistol.

I've carried with a permit since 1991, concealed, open, loaded, unloaded, in the glove box, in the trunk, any which way I wanted....sometimes in the presence of LEO's I knew or didn't know at all. I have been asked for my permit zero times. As far as I know as long as you are not committing a crime anything goes. Except for schools, courthouses and a few employers.....and of course NYC.

DCNewYork...Judging by the lack of punctuation, correct grammar, capitalizations and correct spelling I seriously doubt that you are currently attending any law school.  Nice attempt at trying to fool the members of GB Outdoors but we are not so easily fooled.  You may want to try your tactics in other places...

LOL.... Ok, I am more than appologetic for my crude and quick type job. I was in an extreme rush, my ride was leaving; Me Culpa. I am not yet in law school, I am in my last year of pre-law in SUNY Cortland, next semester I will be in lawschool, enless they enact the draft again, lol. I guess that I am also guilty of being a little bit anti-cop; I have had a few dealing with some great ones and some not so great, that does taint my judgment a little. Even though I believe that T.R. was one of the best presidents; I dont agree with carrying a big stick exposed, in public.   I guess if someone feels a need to walk around with a pistol strapped and swinging from their hip, that is their choice. I perfer a more discreet approach, I dont like to make people nervous or scared of me.

O.k. Now I have to go and provide some joker with my personal information. I have been excepted to Cornell LAW SCHOOL..... I have paid money, I have taken tests, I have provided my transcripts, oh did I mention I have paid money (i.e. tuition)..... this is to continue my law education.... that I am presently enrolled in. I take legal classes, I read legal texts. I do have a little experiance in some legal matters, I also have to deal with many political issues, since they many times go hand in hand. I never said that I have completed law school, nor did I say I was a lawyer, nor did I say I am a legal Expert.    When someone is excepted .....they are than; at that point in time, IN. I do not know and don't really care about your educational background, I dont judge people by how much some university says that they know, I realize that street smarts do count for something, and life experiance counts for even more. I will not make judgements about a persons intelligence from the way they type either, I know many people who are extremly smart and knowlegable, but they can not even turn on a computer. I also know some very smart people who may seem scatterbrained and dis-organized, some can barely spell.

OK...Back to carrying a pistol in the woods.
