Judge uses new law to take guns from Carmel man

By James A. Gillaspy

NOBLESVILLE, Ind. -- A judge today blocked a Carmel man's attempt to retrieve his legally-owned guns from police custody.
The ruling by Hamilton Superior Court Judge Steve Nation may be the first use of a new state law enacted after the 2004 slaying of an Indianapolis policeman by a rampaging mental patient.

Carmel resident Brian Sloan, 39, appeared before Nation today to request the return of his .410 shotgun and 22-caliber rifle.

Both had been seized by Carmel police on Sept. 7 after Sloan's mother called them to report her son armed and drunk and in need of medical attention.

*FW Note:

OK.  Let's get this up-front.  Nobody really wants a sicko to have access to a gun.

His mommy said he was a bad boy in a bad mood and the cops used that opportunity to violate his rights.  Now he's wearing a "mental-case" label and the cops have his guns.

But what had he done that was against the law or that harmed anyone?  Was it the drunk and armed thing?

Like I said, nobody wants to deal with armed sickos, but what's the greater danger?  The occassional danagerous person with a gun or the police being able to disarm citizens and impound their arms simply because their mother (or any other "concerned" citizen) asks them to?

They may talk of a "New Order" in the  world, but what they have in mind is only a revival of the oldest and worst tyranny.   No liberty, no religion, no hope.   It is an unholy alliance of power and pelf to dominate and to enslave the human race.
