Encore Pistols now Legal again in CA?

Was reading on some other forums that the Encore and Contender will be legal to be sold again in CA.  This is based on a new law that went into effect on 1/1/06.

I copied this from the CA attorney General's web site


"SB 269 (Stats. 2005, ch. 683) (Dutton)

Exempts from unsafe handgun testing, as specified, single-shot pistols with a barrel length of not less than six inches and an overall length of at least 10 ½ inches when the handle, frame or receiver and barrel are assembled (PC § 12133). "

Now to get TC and the dealers to commit to get them here!  Anyone in CA working on getting one?

Just signed the paperwork on a brand new G2 14" 44 mag. :D

Got it from M&M trading post shipped to my FFL. Great deal too, $365 for the whole package! Brand new! :grin:

Only thing is, it has to be a complete gun, not just the frame. But heck at that price i needed a 44 mag barrel anyway! Check them out- they are closing out everything.

I have been looking at getting one.  Reeds in San Jose has 2 in blue steel in stock.  I was going to get a s/s one until I saw the new pro hunter line.  I want one of those.  Most shops I have talked to don't know jack about the law, but some have quoted prices and will order them.  Reeds is the only one near me with them in stock.

No biggie about the frame vs gun, I'd have to start out with a whole gun anyway.  Will look for M&M, don't have any in this part of the state.

Hey Chris were there any s/s ones there?  What shops did you see them in?  I am only about 70 miles from Sac; I could save time ordering one if they are already in stock.

I work in a gun shop in the Sacramento area and every day I check the approved pistol list from the DOJ and as of yet there are no Thompsons that are on the list. You are only able to purchase one as a private party transfer.

It will never be on the approved handgun list because SB-269 makes them exempt, like the olympic pistols.  Check the DOJ website bulletin page.  It shows this exemption went into efffect the first of the year.

I agree, it does NOT HAVE TO BE APPROVED!  It just has to meet the description as defined by the law.  Besides, some of the guys are already buying them.

I did the paperwork on one Monday and what I saw was an Exempt List that had just a s*** load of caliber/barrel length combinations.


I don't know where these came from but I did notice that some popular calibers were missing.

Handi, i think what they mean is the frame alone is not available in Ca. but then again the box it came in had stickers all over it stating what you copied. I just called them and talked to Mike. I wanted to send a barrel to him to make it a complete gun, but he said that wouldnt work.

Just got off the phone with DOJ, no Thompson pistols with interchangeable barrels are legal for sale in Calif. The only pistols that meet sb269 requirements have a fixed barrel.

My FFL said he talked to DOJ and they said T/C pistols are ok as long as they meet a required minimum length. Wow :eek:  this whole thing is getting confusing! I say get em while you can! :P

Here is the copy and paste from Attorney G's site for SB269

NOWHERE does it say interchangable barrel guns are not exempt, in fact the wording suggests otherwise.   "overall length of at least 10 ½ inches when the handle, frame or receiver and barrel are assembled"  why would it have to be "assembled" to meet this requirement.  I think the one you talked to at DOJ doesn't know what they are talking about.

I'm sure if we call TC Arms (I forgot my cell phone this am) they have some proof of the exemption.  I have talked to CA DOJ on several occasion and can assure you you get different answers from diff folks.  The fact is they have to uphold the LAW not their opinion.  I've had DOJ people tell me ANY AR receiver that was modifyied to prevent it from accepting a removable magazine, would make it legal.  I asked that question directly, referring to having a 10 round mag rivited in place.  They answered, that it wuld pass, but would have to be visually inspected and certified by them.  Just like the FAB 10 receiver, he has a letter of exemption for EACH receiver he sells, to prove it is legal in CA.

I have a copy of SB269 next to the computer that I use to fill out the Calif. DROS and when you fill out the DROS for a handgun you have a drop down list from DOJ that you have to use to identify the gun. The list does not have any T/C pistols on it and will not let you enter any pistol on the DROS that is not on the list. The person that I talked to at DOJ this morning is a inspector for the department and I can only go by what I was told, if you find a dealer that will sell you a T/C I would suggest you buy one as soon as possible.---------Jim---------

Did you ask him what handguns DID qualify as exempt?  The Rem XP 100 is the only other singleshot handgun made that will fit the description.  I cannot imagine them making a law for a gun that is no longer produced.

I've called several dealers and all say they can get them for me.  The only dificulty I have is locating the Encore with a 44 mag barrel on it.  I may just have to buy them seperate and YES they will sell them that way.  I guess when the cash goes on the table that will be the telling story.

I'll grab a receiver very quick.

Jim, I think your missing something somewhere. I saw the drop down exempt list with the Thompson's on Monday when I did mine.

I post the results when I pick it up (or don't) after the 10 day period.

I stand corrected-----------after the fifth phone call to DOJ in the last three days I finally got hold of someone who gave me the correct ruling of SB269 and was told that T/C pistols are legal for sale in Calif. Called my boss and told him to order some for our shop.--------Jim

I sent  an E-Mail off to the california DOJ this last week-end
and this was there reply........... :D

If that firearm meets the length criteria (SB269), it would be legal.   Apparently, there may be different models out there that  don't meet the criteria.   Also, we get a few inquires if it can be DROS'd as a rifle (by passing the handgun restrictions). No, it cannot be DROS'd as a rifle, even if a longer barrel is put on it.

An act to amend Section 12133 of the Penal Code, relating to unsafe
handguns.

Existing law exempts certain specified handguns from satisfying the
requirements necessary for a handgun not to be classified as unsafe.
This bill would also exempt single-shot pistols with a barrel length of
not less than 6 inches and which has an overall length of at least 10½
inches when the handle, frame or receiver, and barrel are assembled.
The people of the State of California do enact as follows:
SECTION 1. Section 12133 of the Penal Code is amended to read:
12133. (a) The provisions of this chapter shall not apply to a
single-action revolver that has at least a 5-cartridge capacity with a barrel
length of not less than three inches, and meets any of the following
specifications:
(1) Was originally manufactured prior to 1900 and is a curio or relic, as
defined in Section 478.11 of Title 27 of the Code of Federal Regulations.
(2) Has an overall length measured parallel to the barrel of at least 7 1/2
inches when the handle, frame or receiver, and barrel are assembled.
(3) Has an overall length measured parallel to the barrel of at least 7 1/2
inches when the handle, frame or receiver, and barrel are assembled and
that is currently approved for importation into the United States pursuant
to the provisions of paragraph (3) of subsection (d) of Section 925 of Title
18 of the United States Code.
(b) The provisions of this chapter shall not apply to a single-shot pistol
with a barrel length of not less than six inches and that has an overall
length of at least 10½ inches when the handle, frame or receiver, and
barrel are assembled.

I ordered a new s/s encore receiver from Reed's on Sunday.  They didn't tell me how long it would take to get it here, but however long I think will be too long.  I have been trying to get one of these for too long.  Also there is a selection on the DROS menu for just receivers.
