BUFFALO BILLs SHOOTING STORE, ORLANDO FLORIDA

CAUTION TO FELLOW MUZZLELOADERS

I bought a Flintlock through GunBroker from Buffalo Bills Shooting Store, Orlando, Florida…and after Emailing many detailed questions that I’ve learned to ask over the years.

The rifle arrived but its condition had been misrepresented…there were several fingernail-sized patches of rust on the barrel in spite of my specific references to rust in my Emails.
In addition, the barrel was poorly packed, just slid loose into a cardboard box, and was severely damaged in shipment.

Buffalo Bill’s said to return it for a complete refund, however, after they got the rifle back from me, they then announced that their “policy” is not to refund shipping costs under any circumstances and they would not be giving me a complete refund.

Even GunBroker management attempted to reason with Buffalo Bills but had no actual leverage to force him to refund the shipping and he essentially told them to buzz off.

Summary of Buffalo Bill’s poor and unethical handling of my transaction:
The return was only made as a result of misrepresentation, and damage caused by poor packing…both the responsibility of Buffalo Bills.
1)They misrepresented the condition of the rifle in spite of my specific Email references about it’s condition ahead of time;
2)They very poorly packed it resulting in severe damage to the barrel;
3)They first agreed/committed, then reneged on their responsibility to give me a complete refund for the return of the rifle.

Based upon the unethical behavior of Bills Shooting Store with this transaction, I am warning all fellow muzzleloaders to think long and hard about buying anything from them…even getting Email confirmations and commitments made no difference to the ethical standards displayed by Buffalo Bills Shooting Store in Orlando.

roundball had a similer situation here in oz when i ordered a new semi finished stock for my tryon plains rifle the one i ordered when it got to me was broken in half it was just wraped in brown paper no box. rang the distributer and he said he would send me a new one and pay all the shipping. he then rang me a week later and said he had just got two maple stocks for the tryon,he had orderd one for some one and the factory had sent two all with the meatle work fitted, he said i could one for $600 thats ozy dollars so i said ok. when the stock arived i checked my visa statement and he had charged me shipping when he said he would not and also give me back my shipping cost sending the broken stock back to him,rang him and he said you dont expect me to ware the cost do you i said if you had sent the first stock proprly packed it would not of got broken,and if he did not give me the two lots of shipping i would thake him to the consumer protection when i said that, he came to th party so we get them here as well and they dont always pay up like mine did,most dont.there are some low lifes in this world i for one could never cheat any body out of anything i could not sleep a night,but thats why we are called honest and they low lifes.but  they still make me mad.

It really is disgusting isn't it...we're only talking $18 US...hardly earth shattering...it's the princple of it to me.

I don't treat people like this and I don't appreciate getting this sort of treatment...I enter into these transactions open, honest and in good faith, get the money to them ASAP, and then have to put up with their dishonesty.

There have to be some sort of consequence for actions in our society and one of them is word of mouth advertisement, good or bad...and if at least one person who reads this avoids getting this kind of unethical treatment from Buffalo Bills then it will have been worth something.

Ok, a gun on gunbroker.com, internet auction.  represented and in e-mails sent expressly to you, mis stated facts.  Check your state's, Long Arm Statute.  If a misrepresentation communicated to your e-mail, induced you to bid and purchase, you have them in a form of commercial misrepresentation.  Your state may have a cosumer protection law which permits triple damages.  You need to do some research for that.  Then, check and see how many deals the seller has had in interstate commerce and whether they regularly ship to your state.  I'd sue that bugger's in small claims court for every dime and court costs.  You will have to look up the proper legal entity of the seller and if a corp, it's resident agent for service of the papers.  In Maryland small claims court, it would cost around $30.00 to sue, with certified mail service.  They will have to come to your state to defend, which they probably won't.  Then get a copy of the judgment, under "triple seal"  the clerk will know what this means, and pay to file the judgement in the property records of Florida county where the seller is.  You won't believe how much that can mess up their credit and prevent future loans.   They will then have to hire a lawyer to ty to prove the judgment was rendered without jurisdiction in your state.  It will cost them at least five hundred dollars.  You may be out a few more dollars, but it will cost them plenty times what you are out.    I recently sued an internet seller in Maryland over $22.00 on merchandise that wasn't delivered.  (I paid extra for insurance which the buyer didn't purchase but kept the money for.)  Got a judgment for treble damages and costs.  I filed that in Kansas in the property records and suddenly a few months later the seller was trying to refi his house and my judgment "queered" his refi.   He paid up right quick.  

If you don't stand up to these internet bullies, they won't learn any leson.

I hear you...and this is not to sound like "I've got money" cause I don't...but I'm not going to expend that much negative energy and keep myself all riled up over $18.

The incident took place on the Internet, so I decided to publicly state the honest facts on the Internet, on forums frequented by the very kind of potential customers he'd be interested in attracting.

Considering all the forums I've listed it on, it's been viewed by a couple thousand folks already...if he misses one sale as a result, he'll have lost far more than the pitiful $18.

I also posted negative feedback on GunBroker which takes his tally of negatives up to 4 and GunBroker management said they'd wade in if he attempts to retailate...so I'm done with it.

I think this is a wise decision.  If all you ever loose is $18 your a lucky man.  You can expend far more than $18 dollars worth of energy on this and I think you've done about all the makes sense.   Chalk this up as an $18 dollar lesson and be thankful it wasn't a $100, or $1000 lesson! :?
